As regards the applicant’s complaint that his views were heard after the Secretary-General had consulted the Quaestors, with the result that the latter were not able to take account of his comments, it must be recalled that, as consultation with the Quaestors does not bind the Secretary-General as regards his decision on the inference to be drawn from the absence of supporting documents, the fact that the applicant’s views were heard after the said consultation was not such as to infringe the rights of the defence.

I am grateful to Mr Varela for highlighting this in his report in a very positive way. He said in his report, 'the system for protecting dolphins in purse-seine fisheries established by the AIDCP, .is far removed from other private certification schemes which have hitherto been introduced'.

I totally support the rapporteur in his comments on the lack of resources in the Commission to deal with health and safety policy and, in particular, the need for a detailed and costed action plan and a very strict timetable for improving legislation in this very important area.
