All of this is unsatisfactory, but it goes back to the three points I mentioned: the reform, which was being put in place progressively, with things that inevitably go wrong during the switchover, OLAF-Commission relations that were still not clearly defined, and lastly, the lack of transparency and communication in Eurostat.

In parallel, the Commission is proposing changes to the 1999 OLAF Regulation to strengthen the operational efficiency of the Office, to improve information flow between OLAF and the EU Institutions, to further safeguard the rights of individuals who may be involved in the subject of inquiry, to deal with factors which appear to jeopardise the effectiveness of OLAF investigations, and to enhance the role of the independent OLAF Supervisory Committee.
Parallèlement, la Commission propose une modification du règlement de l'OLAF de 1999 afin de renforcer l'efficacité opérationnelle de ce dernier, d'améliorer le flux d'information entre l'OLAF et les institutions de l'UE, de mieux préserver les droits des personnes qui pourraient être concernées par une enquête, d'agir sur les facteurs qui nuisent à l'efficacité des investigations de l'OLAF, et de renforcer le rôle du comité de surveillance de l'OLAF, qui est une instance indépendante.

REQUESTS that the report be completed at the latest by the end of 2004, examining the actual results achieved since the creation of OLAF in addition to the aspects linked to the legislative and statutory framework and OLAF's tasks already dealt with by the Commission, and welcomes the Supervisory Committee's willingness to take part; in order to have a complete view of OLAF's operation, the Council also recommends conducting an external management audit on OLAF within two years at the latest;
