Question No. 92 Ms. Jean Crowder: With regards to band council elections: (a) for each calendar year since the Corbière Decision came into effect, how many bands have had an election and what were the costs of those elections; (b) what plans does the Minister of Indian Affairs and Northern Development have to request an extension of the financial authority from the Treasury Board to continue funding these additional costs for band elections; (c) what is the average cost of a band council election relative to the overall Band Support Funding for First Nations; (d) how many elections have been disputed since 1999 and what were the costs for each of those elections; (e) for those disputed elections, what was the percentage cost of the election as a portion of Band Support Funding and as a portion of own source revenue for the First Nation involved; (f) what studies or audits have been conducted to see how much of the annual two percent funding cap on Indian and Northern Affairs Canada program spending since 1995 has gone to pay for the increased costs of band council elections; (g) how much would Band Support Funding need to increase to cover the increased costs of the Corbière Decision without impacting other program spending; (h) how will the government live up to its fiduciary responsibility for First Nations if the two percent spending cap remains in place; and (i) how will the Honour of the Crown be protected in this matter?

Therefore if we're making the bands accountable and transparent to the band memberships in other words, band members can access that kind of information from the band councils on everything from how many dollars go into health care, and how many dollars go into economic development, or what the chief's salary or the council persons' salaries are then that same degree of accountability for the tribal council operation has to be available through the band council to the band members.

Although the Commission had proposed twice to set up a rate band of 15% of the minimum rate and 25% of the maximum rate (derived from the real rates applied in the Member States - no Member State applies the VAT standard rate higher than 25%), the Council rejected the proposals in both cases, keeping only the provisions on the 15% minimum.

The current Council Regulation No 3760/92 establishing a Community system for fisheries and aquaculture, provides for derogations in respect of the internal market, notably in Articles 6 and 7, which allow derogations from the principle of freedom of access to fishing grounds, so that Member States have the right of exclusive exploitation of their fisheries resources within a 12-mile coastal band, as well as a series of preferential fishing rights, through application of the ‘relative stability’ principle, which distributes national fishing quotas.

I would like to inform committee members that there is an elected representative of the Odanak Band Council, a councillor named Réjean O'Bomsawin, a member of the Coalition of Abenaki Citizens, who has been actively promoting accountability and transparency within the Odanak Band Council but who has been repeatedly isolated, segregated and excluded from Odanak Band Council decisions by the chief, other council members and even the Odanak band office's general director.
