Calls on the Philippines, as one of the countries having been granted GSP+ status by the EU, to ensure effective implementation of all the core international conventions relating to human and labour rights, the environment and good governance, as listed in Annex VIII to Regulation (EU) No 978/2012; recognises that the Philippines have strengthened their human rights legislation; calls on the Philippines to continue fostering further progress in the promotion of human rights, including the publication of the National Action Plan for Human Rights, as well as in the elimination of corruption; expresses particular concern with regard to the repression faced by activists who are peacefully campaigning to protect their ancestral lands from the impact of mining and deforestation; recalls that under the GSP+ beneficiaries will have to prove that they are implementing their obligations concerning human rights, labour, environmental and governance standards.

In this regard, civil society is to be understood as spanning all types of social actions by individuals or groups that are independent from the state and whose activities help to promote human rights and democracy, including human rights defenders as defined by the UN Declaration on the Right and Responsibility of Individuals, Groups and Organs of Society to Promote and Protect Universally Recognized Human Rights and Fundamental Freedoms (‘Declaration on Human Rights Defenders’).

Regrets China's postponement of the eleventh China-EU summit on the grounds of the Dalai Lama's visit to Europe; emphasises the need for a radical intensification and re-thinking of the European Union-China human rights dialogue; expresses its disquiet at the serious human rights violations in China and stresses that, despite promises made by the regime before the Olympic Games in August 2008, the situation on the ground regarding human rights has not improved; points out, moreover, that restrictions on freedom of association, expression and religion have been further tightened; strongly condemns the crackdown against Tibetans following the wave of protests that swept across Tibet beginning on 10 March 2008 and the repression by the Chinese government that has increased in Tibet since then, and calls for the restart of a sincere and results-oriented dialogue between both parties based on the "Memorandum on Genuine Autonomy for the Tibetan People"; notes that, despite repeated assurances by the Chinese government of its intention to ratify the International Covenant on Civil and Political Rights, ratification is still pending; refers to Parliament's resolution of 17 January 2008 on the arrest of the Chinese dissident Hu Jia , who has been awarded the 2008 Sakharov Prize for Freedom of Thought; calls on the Chinese government to release Hu Jia immediately and to lift the house arrest on his wife Zeng Jinyan and his daughter; condemns the wave of repression against signatories of the "Charter 08", a document calling for democratic reforms in China and demanding the release of Liu Xiaobo, a dissident who has been detained since 9 December 2008; expresses concern that the legal system remains vulnerable to arbitrary and often politically-motivated interference, including the State Secrets system, preventing the transparency necessary for the development of good governance and a system in which the rule of law prevails; in this context, deplores the systemat ...

ACKNOWLEDGING the necessity of observing human rights and freedoms, and emphasising that this Agreement shall be without prejudice to the rights and obligations of the Community, the Member States of the European Union and Ukraine arising from the Universal Declaration of Human Rights of 10 December 1948 and from international law, in particular, from the European Convention of 4 November 1950 for the Protection of Human Rights and Fundamental Freedoms, the Convention of 28 July 1951 and the Protocol of 31 January 1967 on the Status of Refugees, the international Covenant on Civil and Political Rights of 19 December 1966 and international instruments on extradition,

G. The Charter embraces the classical human rights of the ECHR as developed by the jurisprudence of the European Court of Human Rights in Strasbourg. It has a much wider scope, however. First, as befits a catalogue of rights that stem from the competence of the European Union as laid down in the Treaties and as developed by the case law of the European Court of Justice in Luxembourg. Second, importantly, the Charter reaffirms the rights and principles resulting from the constitutional traditions and international treaty obligations common to Member States.Third, the Charter addresses modern scientific and technological developments. Fourth, the Charter fully reflects and respects the European social model;

We must take the UN concept of human rights as our basis, and this comprises three central categories: firstly, what might be termed the negative rights to freedom, i.e. the right of each person to enjoy freedom from unjustified state coercion and other violence. Secondly, the positive rights: these guarantee the participation of the individual in political and social decision-making processes. And thirdly, social rights and the right to development which are invoked particularly by third world countries: they insist that civil and political rights also include the conditions that are necessary in order to exercise these rights.

Whoever wants to reduce the number of human rights - or even half them - should bear in mind the words of President Roosevelt when he formulated the anti-fascist war objective in 1941: he said that freedom from material want should have the same status as freedom of speech, freedom of belief and freedom from fear.
À celui qui voudrait "dégraisser" voire "amputer" les droits de l'homme, il convient de rappeler l'objectif que le Président Roosevelt avait assigné, en 1941, à la guerre contre les fascistes, à savoir qu'il fallait mettre sur un pied d'égalité la lutte contre la détresse matérielle et la défense de la liberté de parole et de pensée et du droit de vivre sans crainte.
