B. considérant que la demande de Gabriele Albertini concerne un acte d'assignation déposé contre lui devant le tribunal de Milan au nom d'Alfredo Robledo concernant des déclarations faites par Gabriele Albertini lors d'un premier entretien publié par le quotidien italien Il sole 24 Ore le 26 octobre 2011 et lors d'un deuxième entretien publié par le quotidien italien Corriere della Sera le 19 février 2012;

H. whereas the facts of the case, as manifested in the writ of summons and in Gabriele Albertini’s oral explication to the Committee on Legal Affairs, indicate that the statements made do not have a direct and obvious connection with Gabriele Albertini’s performance of his duties as a Member of the European Parliament;
H. considérant que les faits en cause, tels qu'exposés dans l'acte d'assignation et dans les explications présentées oralement par Gabriele Albertini devant la commission des affaires juridiques, indiquent que les déclarations faites n'ont pas de rapport direct et évident avec l'exercice par Gabriele Albertini de ses fonctions de député au Parlement européen;
