5. Where controls or audits demonstrate systemic or recurrent errors, irregularities, fraud or breach of obligations attributable to the beneficiary and having a material impact on a number of grants awarded to that beneficiary under similar conditions, the authorising officer responsible may suspend implementation of all the grants concerned or, where appropriate, terminate the concerned grant agreements or decisions with that beneficiary, in proportion to the seriousness of the errors, irregularities, fraud or of the breach of obligations, provided that the beneficiary has been given the opportunity to make observations.
5. Si des contrôles ou audits révèlent l'existence d'erreurs, d'irrégularités, de fraudes ou de violations des obligations systémiques ou récurrentes imputables au bénéficiaire et ayant une incidence matérielle sur plusieurs subventions qui ont été octroyées audit bénéficiaire dans des conditions similaires, l'ordonnateur compétent peut suspendre la mise en œuvre de toutes les subventions concernées ou, le cas échéant, résilier les conventions ou décisions de subvention concernées passées avec ce bénéficiaire, en proportion de la gravité des erreurs, des irrégularités, des fraudes ou des violations des obligations, à condition que le bénéficiaire ait eu la possibilité de présenter des observations.

2a. Where, after the award of the grant, the award procedure or the implementation of the grant proves to have been subject to substantial errors, irregularities or fraud, the authorising officer responsible may, depending on the stage reached in the procedure, refrain from signing the grant agreement or notifying the grant decision, suspend implementation of the grant or, where appropriate, terminate the grant agreement or decision after the applicant or beneficiary has been given the opportunity to make his observations.
2 bis. This Convention neither requires nor precludes the grant, refusal or termination of interim measures of protection by a court of a Contracting State and does not affect whether or not a party may request or a court should grant, refuse or terminate such measures.

If the breach of duty is not due to the conduct of the beneficiary, the grant shall be suspended, reduced or terminated only in exceptional cases, particularly if implementing or upholding the grant would result in the ceiling for project costs eligible for financing being exceeded or if the dereliction of duty has the effect of making it impossible for the aim of the grant to be achieved any longer'.
