Definition: This block contains a wide variety of disorders that differ in severity and clinical form but that are all attributable to the use of one or more psychoactive substances, which may or may not have been medically prescribed. The third character of the code identifies the substance involved, and the fourth character specifies the clinical state. The codes should be used, as required, for each substance specified, but it should be noted that not all fourth character codes are applicable to all substances. Identification of the psychoactive substance should be based on as many sources of information as possible. As an exception to this general principle, the European company (SE) Regulation and Directive rules should apply if at least one of the merging companies has an average number of employees in the six months before the publication of the draft terms of the cross-border merger that exceeds 500 and is operating under an employee participation system, or where the national law applicable to the company resulting from the cross-border merger does not provide for at least the same level of participation as operated in the relevant merging companies, measured by reference to the proportion of members of the administrative or of the supervisory organ or their committees or of the management group, which covers the profit units of the company, subject to employee representation, or provide for employees of establishments of the company resulting from the cross-border merger and situated in other Member States the same entitlement to exercise participation rights as is enjoyed by those employees employed in the Member State where the registered office of the company resulting from the cross-border merger is situated.
À titre d'exception à ce principe général, les règles fixées par le règlement et la directive sur la société européenne devraient être d'application si au moins une des sociétés qui participent à la fusion emploie pendant la période de six mois précédant la publication du projet de fusion transfrontalière un nombre moyen de travailleurs supérieur à 500 et est gérée selon un régime de participation des travailleurs, ou si la législation nationale applicable à la société issue de la fusion transfrontalière ne prévoit pas au moins le même niveau de participation que celui qui s'applique aux sociétés concernées qui fusionnent, mesuré en fonction du nombre de membres du conseil d'administration ou du conseil de surveillance ou de leurs comités ou des entités des sociétés relevant d'un régime de participation des travailleurs qui décident de la destination des bénéfices, ou ne prévoit pas que les travailleurs des établissements de la société qui participe à la fusion transfrontalière et situés dans d'autres États membres peuvent exercer les mêmes droits de participation que ceux dont bénéficient les travailleurs employés dans l'État membre où le siège statutaire de la société issue de la fusion transfrontalière est établi.
