This update is in the framework of the guidelines adopted by the Commission in 2004, which established the main principles of the GSP for 2006 to 2015.

The Communication of 7 July 2004 from the Commission to the Council, the European Parliament and the European Economic and Social Committee, entitled ‘Developing countries, international trade and sustainable development: the function of the Community’s generalised system of preferences (GSP) for the 10-year period from 2006 to 2015’, sets out the guidelines for the application of the scheme of generalised tariff preferences for the period 2006 to 2015.

- In order to support this objective, the GSP will therefore provide the first opportunity to apply these general guidelines for improving rules of origin, subject to fine-tuning the details of their implementation.

Your rapporteur therefore regrets that, contrary to what was said in the July communication on GSP guidelines and contrary to what Commissioner Lamy himself announced in Parliament at the debate of 14 October, the initial Commission proposal set the date for the full entry into force of the new regulation at 1 July 2005, instead of 1 January 2006 as initially scheduled, making it impossible to ensure an orderly transition to the application of the new special arrangements.

On 20 October 2004, in anticipation of the expiry on 31 December 2005 of Council Regulation (EC) No 2501/2001 applying a multiannual scheme of generalised tariff preferences (GSP), and following the adoption in July 2004 of the Guidelines on the Role of the GSP for the next 10 year period, 2006-2015 (COM(2004)0461), the Commission published a first proposal for a first Council regulation applying the new GSP (COM (2004)699).

Regrets that this important Communication, which sets out new ten-year guidelines for the GSP, does not refer to any prior thorough evaluation of the functioning and impact of the current GSP, and requests the Commission to provide decision-makers with solid elements of information on both the need for reform and the potential for improvement;

Likewise, those agreements currently in the pipeline (i.e. those with Mercosur and Chile) ought to be finalised, whilst new negotiating guidelines would be required in order for association agreements to be concluded with the Andean Community and Central America in the medium term. Lastly, in the meantime, the terms of the Community GSP from which the Andean and Central American countries benefit ought to be maintained in the short and medium term.
