On 30 November 2016, the UN Security Council adopted Resolution 2321 (2016), expressing its gravest concern at the nuclear test conducted by the DPRK on 9 September 2016 in violation of the relevant UN Security Council Resolutions, further condemning the DPRK's ongoing nuclear and ballistic-missile activities and declaring them to be in serious violation of the relevant UN Security Council Resolutions, and determining that such activities continue to represent a clear threat to international peace and security in the region and beyond.
Le 30 novembre 2016, le Conseil de sécurité des Nations unies a adopté la résolution 2321 (2016) dans laquelle il s'est déclaré très profondément préoccupé par l'essai nucléaire effectué le 9 septembre 2016 par la RPDC en violation de ses résolutions pertinentes, a condamné à nouveau les activités relatives aux programmes d'armes nucléaires ou de missiles balistiques de la RPDC, déclarant que celles-ci violaient de manière flagrante ses résolutions sur la question, et a indiqué que ces activités continuaient de constituer une menace manifeste pour la paix et la sécurité internationales, dans la région et au-delà.

N. whereas international humanitarian and human rights law prohibits the targeting of individuals or groups based on religious or ethnic identity, as well as attacks against civilians not taking part in hostilities; whereas such actions may constitute war crimes and crimes against humanity; whereas UN Security Council resolution 2139 stressed the need to end impunity for violations of international humanitarian law and violations and abuses of human rights, and reaffirmed that those who had committed or were otherwise responsible for such violations and abuses in Syria must be brought to justice;
N. considérant qu'en vertu du droit humanitaire international et des droits de l'homme, il est interdit de s'en prendre à des personnes ou à des groupes en fonction de leur appartenance religieuse ou ethnique et de s'attaquer à des civils étrangers au conflit; que de tels actes peuvent constituer des crimes de guerre et des crimes contre l'humanité; que, par sa résolution 2139, le Conseil de sécurité des Nations Unies a souligné la nécessité de mettre fin à l'impunité des auteurs de violations du droit humanitaire international et d'atteintes aux droits de l'homme, et a réaffirmé que les auteurs ou les responsables de tels actes en Syrie devaient être traduits en justice;

11. Notes the recognition of the concept of the 'responsibility to protect' in the above-mentioned UN Resolution 60/1 in response to the increase in violations of IHL and human rights and to the powerlessness or unwillingness of governments to protect their own citizens; recalls that humanitarian aid is one of the ways in which the international community can contribute to the protection of threatened peoples and stresses the EU's concern not to remain inactive in the face of such violations; calls for a thorough political debate in the Member States and EU institutions on the right, or indeed the duty, of intervention in cases of serious violation of IHL and/or human rights, taking also into account the conclusions and recommendations of the above-mentioned Report of December 2001 by the International Commission on Intervention and State Sovereignty on "The responsibility to protect";
11. prend acte de la reconnaissance du concept de "responsabilité de protéger" dans la résolution 60/1 des Nations unies, précitée, à la suite notamment de l'augmentation des violations du droit humanitaire international et des droits de l'homme et de l'impuissance des gouvernements à protéger leurs propres citoyens, ou de leur absence de volonté; rappelle que l'aide humanitaire est un des moyens dont dispose la communauté internationale pour contribuer à la protection des populations menacées et souligne le souci de l'Union de ne pas rester sans réaction face à de telles violations; appelle à un débat politique approfondi des États membres et des institutions de l'Union sur le droit, voire le devoir d'ingérence en cas de violation grave du droit humanitaire international ou des droits de l'homme, en prenant également en compte les conclusions et recommandations du rapport précité de la Commission internationale de l'intervention et de la souveraineté des États "La responsabilité de protéger" de décembre 2001;

7. If the tribunal determines that there has been a violation of this Agreement and the responsible Party does not cure the violation, or does not reach agreement with the other Party on a mutually satisfactory resolution within 40 days after notification of the tribunal's decision, the other Party may suspend the application of comparable benefits arising under this Agreement until such time as the Parties have reached agreement on a resolution of the dispute.
7. Si le tribunal estime qu'il y a eu violation du présent accord et que la partie responsable de cette violation n'y remédie pas ou ne parvient pas, dans les quarante jours suivant la notification de la décision du tribunal, à un accord mutuellement acceptable avec l'autre partie, cette dernière peut suspendre l'application d'avantages comparables découlant du présent accord, jusqu'à ce que les parties parviennent à régler le différend.

5. Urges the Council and the Member States to take all the necessary measures to bring those Iraq régime officials responsible for serious violations of international humanitarian law carried out within Iraq territories and beyond before an ad hoc international tribunal for Iraq; such a tribunal to be established either by United Nations Security Council Resolution under Chapter VII of the UN Charter or pursuant to treaty by the concerned and injured states; and being required, since Article 11 Jurisdiction ratione temporis of the Rome Statute of the International Criminal Court gives jurisdiction only with respect to crimes committed after the entry into force of the Statute, namely, 1 July 2002; while awaiting such establishment, further proposes the setting-up of an Office of Inquiry for human rights violations, in order to prepare both the necessary evidence and an official register of the numerous violations perpetrated by the Iraqi régime; calls on the EU to enable this Office without delay;
5. demande instamment au Conseil et aux États membres de prendre toutes les mesures nécessaires pour que les dirigeants du régime irakien responsables de graves violations du droit international en matière humanitaire sur le territoire de l'Irak ou au-dehors comparaissent devant un Tribunal international ad hoc sur l'Irak; estime qu'un tel tribunal pourrait être fondé soit par une résolution du Conseil de sécurité au titre du chapitre VII de la Charte des Nations unie, soit sur la base de traités avec les États concernés et lésés; estime par ailleurs que cela reste nécessaire puisque l'article 11 du statut de Rome de la Cour pénale internationale dispose, quant à la compétence ratione temporis, que le Cour n'a à connaître que les crimes commis après l'entrée en vigueur du statut, soit après le 1 juillet 2002; en attendant que ce dispositif fonctionne, propose en outre l'instauration d'un bureau d'enquête sur les violations des droits de l'homme, en vue de rassembler les preuves nécessaires et de préparer un registre officiel des nombreuses violations des droits de l'homme perpétrées par le régime irakien; demande à l'UE d'oeuvrer sans délai à la création de ce bureau;
