Let us consider, for example, the hypothetical case of a German citizen who, on retirement, moves from Germany to the south of Spain (where he spends the last decade of his life) and dies there, leaving two sons residing in Germany and an estate comprising property in Germany. In a case of this kind, if the jurisdiction were determined solely on the basis of the deceased person’s habitual place of residence at the time of death, the heirs – supposing they were in dispute over the will – would be obliged to bring the proceedings in question before the Spanish courts.
Imaginons par exemple le cas d'un citoyen allemand qui, après sa retraite, quitte l'Allemagne pour le sud de l'Espagne (où il passe les dix dernières années de sa vie) et qui y meurt, laissant deux enfants résidents en Allemagne et un héritage qui se compose de biens situés en Allemagne; dans un cas de ce genre, si la compétence judiciaire était déterminée uniquement sur la base du pays de résidence habituelle du défunt au moment de la mort, les héritiers - a fortiori si, dans l'intervalle, un conflit les avait opposés - seraient contraints de porter l'affaire devant le juge espagnol.
