Articles 2, 3 and 8(4) of Council Framework Decision 2001/220/JHA of 15 March 2001 on the standing of victims in criminal proceedings must be interpreted as not precluding provisions of national law, such as Articles 392(1a), 398(5a) and 394 of the Italian Code of Criminal Procedure, which, first, do not impose on the Public Prosecutor any obligation to apply to the competent court so that a victim who is particularly vulnerable may be heard and give evidence under the arrangements of the incidente probatorio during the investigation phase of criminal proceedings and, second, do not give to that victim the right to bring an appeal before a court against that decision of the Public Prosecutor rejecting his or her request to be heard and to give evidence under those arrangements.

The decision was taken to propose that the already existing Council Decision on a European Network for the Protection of Public Figures be amended in order to broaden Article 2 defining a "public figure" as an official or non-official position who is deemed to be under threat due to her contribution or impact on the public debate.

For the purposes of this Decision, “public figure” shall mean any person, either in an official capacity or in a non-official position who is deemed to be under threat because of his or her contribution to or impact on the public debate, and who, in the view of the Member State concerned, merits protection, and to whom a protection service is assigned in accordance with the national legislation of a Member State or pursuant to the regulations of an international or supranational organisation or institution’.

Under those circumstances, the Framework Decision would no longer give an adequate guarantee for the citizen against possible misuse of his or her data by public authorities.

As the rapporteur, whom I congratulate on her work, emphasises, it is therefore crucial to adopt bold measures to promote the participation of women in decision-making, which will also require men and women to take on an equal share of responsibilities in public and private life. We must also encourage new anti-discriminatory practices, and that includes within political parties and public and private administrations too, with the aim of eliminating the psychological and practical obstacles to the participation of women in decision-making structures and in political life, thereby preventing retrograde action such as the recent case in Portugal, where the government abolished the Ministry for Equality.
Il faut donc, comme le souligne le rapporteur que je félicite, prendre des mesures courageuses pour promouvoir la participation des femmes à la prise de décision - ce qui implique aussi que les hommes et les femmes assument une même part de responsabilité dans les domaines public et privé - et que l'on encourage de nouvelles pratiques antidiscriminatoires, y compris dans les partis politiques et dans les administrations publiques et privées, afin d'éliminer les obstacles psychologiques et pratiques à la participation des femmes dans les structures de prise de décision et dans la vie politique, en mettant fin aux marches arrière, comme au Portugal, où le gouvernement a récemment supprimé le ministère pour l'égalité des sexes.
