In this regard, calls on the European Union to formally engage with democratic governments from other regional groups in order to start formal cooperation and consultation within the UNHRC with a view to guaranteeing the success of initiatives aimed at the respect of the principles contained in the Universal Declaration of Human Rights; considers that it is only through concerted action by a cross-regional alliance of democratic states that the European Union's multilateral human rights efforts can be effective in United Nations fora, as has been shown by the recent successful adoption, on 18 December 2007, of the abovementioned General Assembly Resolution 62/149 on a moratorium on the use of the death penalty;
demande, à cet égard, à l'Union de s'associer officiellement à des États démocratiques appartenant à d'autres groupes régionaux afin d'engager au sein du CDHNU des actions formelles de coopération et de consultation destinées à garantir la réussite des initiatives en faveur du respect des principes inscrits dans la Déclaration universelle des Droits de l'homme; estime que c'est par l'action concertée d'une alliance interrégionale d'États démocratiques que les efforts déployés par l'Union sur le plan multilatéral porteront leurs fruits dans les enceintes des Nations unies, comme le montre la réussite de l'adoption récente, le 18 décembre 2007, de la résolution 62/149 précitée de l'Assemblée générale demandant un moratoire mondial sur l'application de la peine de mort;

Takes the view that human rights issues should be placed at the highest political level in order to give more political weight to human rights concerns; recalls that the promotion and defence of human rights in third countries should not be conditioned by geopolitical or geo-strategic alliances; stresses that, within the framework of political, economic and trade-related dialogues, respect for human rights should be fundamental to strategic and privileged relations with the EU;

The European Union must show greater courage on this issue: at stake are our credibility and our policy of promoting human rights. It is not enough to protest against countries that are unprotected by often dubious international alliances.
L’Union européenne doit se montrer plus courageuse en la matière, car notre crédibilité et notre politique de promotion des droits de l’homme sont en jeu. Il ne suffit pas de protester contre des pays ne bénéficiant pas de la protection d’alliances internationales souvent douteuses.

Since the issue is a relatively new one and raises certain conceptual difficulties, there is a risk that it may be misunderstood in one way or another and that it will run up against an unholy alliance of opponents: liberals might see it as opening a Pandora's box of arbitrary barriers; the southern countries as protectionism and euro-centrism in disguise; and environmentalists and human-rights activists might see it as representing an unacceptable status quo because it fails to put pressure on those who infringe social standards and destroy the environment.

The business community sees it as a way of gaining access to the large North American Market (although some fear competition from American and Canadian companies) while groups under the umbrella of the Hemispheric Social Alliance (Unions, universities and non-governmental organisations) reject the Agreement due to the lack of consideration for key concerns relating to the environment, workers' rights, social exclusion, foreign debt, democracy and respect for human rights, exploitation of minors and respect for indigenous communities.

II. SOLEMN DECLARATION OF FLORENCE ON THE RENEWAL OF THE SAN JOSÉ PROCESS The European Union and the Member Countries of the Central American Integration System (SICA), - recalling the Final Act of the Luxembourg Conference of 11 and 12 November 1985 giving institutional shape to the political and economic dialogue, - aware of their espousal of common values and principles, such as representative democracy, the Rule of Law and constitutionalism and full respect for universal human rights and fundamental freedoms, - recognizing the significant contribution of the San José Dialogue's first decade and ensuing cooperation to the peace process, the consolidation of democracy, social and economic development in Central America and revitalizing and strengthening the integration process in the region, - persuaded that these achievements should be consolidated and that their relations should be deepened by gearing the objectives and mechanisms of the dialogue and also its content and methods of cooperation to the fresh challenges and new priorities facing them, - highlighting the consistency of the General Guidelines recently adopted by the European Council for Cooperation with Latin America and the priorities defined by the Central American Presidents in the Alliance for Sustainable Development, have, on the occasion of the Twelfth Ministerial Conference in Florence on 21 March 1996, decided to strengthen the San José process along the following lines: Objectives of the San José process The Parties have reaffirmed their resolve to continue the political and economic dialogue launched in 1984 at the San José Conference.
II. DECLARATION SOLENNELLE DE FLORENCE RELATIVE AU RENOUVEAU DU PROCESSUS DE SAN JOSE L'Union européenne et les Etats membres du Système d'intégration centraméricaine (SICA) ; - rappelant l'Acte final de la Conférence de Luxembourg des 11 et 12 novembre 1985, qui a institutionnalisé le dialogue politique et économique ; - conscients de leur attachement à des valeurs et à des principes communs, tels que la démocratie représentative, l'Etat de droit et l'ordre constitutionnel, le plein respect des droits universels de l'homme et des libertés fondamentales ; - reconnaissant la contribution significative de la première décennie du Dialogue de San José et de la coopération y afférente au processus de pacification, à la consolidation de la démocratie, au développement social et économique de l'Amérique centrale, ainsi qu'à la revitalisation et au renforcement du processus d'intégration de la région ; - convaincus de la nécessité de consolider ces acquis et d'approfondir leurs relations en adaptant les objectifs et les mécanismes du dialogue, ainsi que le contenu et les modalités de leur coopération, aux nouveaux défis et aux nouvelles priorités ; - soulignant les concordances entre les orientations générales récemment approuvées par le Conseil européen pour la coopération avec l'Amérique latine et les priorités définies par les présidents d'Amérique centrale au sein de l'Alliance pour le développement durable ; ont décidé, à l'occasion de la Douzième Conférence ministérielle qui s'est tenue à Florence le 21 mars 1996, de développer le processus de San José selon les orientations suivantes : Objectifs du processus de San José Les parties ont réaffirmé leur volonté de poursuivre le dialogue politique et économique engagé en 1984 lors de la Conférence de San José.

The European Council notes with satisfaction that work in progress in the organs of European political cooperation has already, by comparing national policies on arms exports, identified a number of common criteria on which these policies are based, such as: - respect for the international commitments of the member States of the Community, in particular the sanctions decreed by the Security Council of the United Nations and those decreed by the Community, agreements on non-proliferation and other subjects, as well as other international obligations; - the respect of human rights in the country of final destination; - the internal situation in the country of final destination, as a function of the existence of tensions or internal armed conflicts; - the preservation of regional peace, security and stability; - the national security of the member States and of territories whose external relations are the responsibility of a member State, as well as that of friendly and allied countries; - the behaviour of the buyer country with regard to the international community, as regards in particular its attitude to terrorism, the nature of its alliances, and respect for international law; - the existence of a risk that the equipment will be diverted within the buyer country or re-exported under undesirable conditions.
Le Conseil Européen relève avec satisfaction que les travaux en cours au sein des instances européennes ont d'ores et déjà permis, à travers une comparaison des politiques nationales d'exportations d'armes, de dégager nombre de critères communs autour desquels ces politiques s'articulent, tels que: - le respect des engagements internationaux des Etats membres de la Communauté, notamment les sanctions édictées par le Conseil de Sécurité des Nations Unies et celles édictées par la Communauté, les accords de non-proliférations et autres ainsi que d'autres obligations internationales; - le respect des droits de l'homme de la part du pays de destination finale; - la situation intérieure du pays de destination finale en fonction de l'existence de tensions ou de conflits armés internes; - le maintien de la paix, de la sécurité et de la stabilité régionale; - la sécurité nationale des Etats membres, des territoires desquels un Etat membre assume les relations extérieurs, ainsi que celle des pays amis ou alliés; - le comportement du pays acheteur à l'égard de la communauté internationale, s'agissant notamment de son attitude envers le terrorisme, de la nature de ses alliances et du respect du Droit international; - l'existence d'un risque de détournement interne ou d'une réexportation non-souhaitée.
