As well, the UN High Commissioner for Human Rights has recently tabled a report at the end of last year on gender identity and sexual orientation that makes clear that even at the United Nations level, with all the diversity of member states, this is now recognized in human rights terms, and in the European Convention on Human Rights community, where we have almost 50 European countries, gender identity, through the recognition of transsexuals' rights in different parts of the European Convention on Human Rights, has for over a decade been recognized in that area of the world.

Paradoxically, all legal acts of the Member States are subject to scrutiny as regards their implications for human rights by the Commission and Court of Human Rights set up by the Convention of 4 November 1950,1 whereas the acts of the Community are not. The Community institutions enjoy, as it were, some sort of "immunity", which could well be prejudicial to the rights of the Community's citizens.
Paradoxalement, tous les actes juridiques des Etats membres sont soumis à un contrôle du respect des droits de l'homme par la Commission et la Cour des Droits de l'homme instaurées par la CEDH du 4 novembre 1950(1), mais, en revanche, les actes de la Communauté échappent à ce mécanisme de contrôle et ses institutions bénéficient au regard de la Convention d'une sorte d'"immunité" quant à leurs actes, au détriment du système de protection des citoyens.
