Is greatly concerned by the crisis which has gripped the Central African Republic (CAR) since 2003; reiterates its condolences to the families of the victims of the clashes; reiterates its support for the independence, unity and territorial integrity of the CAR; reiterates its support for the ceasefire which resulted from the Brazzaville Agreement, initiation of the ‘disarmament, demobilisation, reconciliation’ (DDR) process, the coming pluralist, transparent legislative and presidential elections, and specific action to protect human rights; recalls the importance of peoples’ right to self-determination without outside interference; calls for the swift withdrawal of French troops from the CAR and the closure of permanent foreign military bases in the country; calls for stronger checks on UN forces and an in-depth, impartial and transparent enquiry into allegations of abuse or crimes committed; is particularly concerned at the vague notions of transnational companies in the CAR, especially those engaged in the extraction of precious stones and the harvesting of timber; recalls the inalienable right of peoples to their natural resources and the obligation of companies to submit to international law; underlines the importance for the EU and its Member States to commit fully – particularly in the Human Rights Council (HRC) – to the establishment by the UN of a binding instrument to be used against companies which fail to respect human rights;

100. Considers it regrettable that a holistic approach to the way in which corporations abide by human rights standards globally is still lacking, and that this is allowing certain states and companies to circumvent such rules; stresses the need, therefore, to adopt rules on corporate social responsibility (CSR); strongly supports the implementation of the UN Guiding Principles on Business and Human Rights; calls, in particular, on the Commission to introduce effective measures to operationalise the ‘Protect, Respect and Remedy’ framework put forward by John Ruggie, the UN Secretary-General’s Special Representative on business and human rights; recalls the importance of promoting CSR principles, including in business operations outside the EU, and ensuring that they are respected throughout the supply chain, in particular with regard to the illegal timber trade, wildlife trafficking and trading of minerals from conflict zones; is convinced that European companies and their subsidiaries and subcontractors should play a key role in the promotion and dissemination of international standards on business and human rights worldwide;

EU-Belarus relations should be based on common values, in particular with regard to human rights, democracy and the rule of law, and it should be recalled that the human rights situation in the Republic of Belarus remains of concern to the Union, in particular with regard to issues such as the death penalty, which should be abolished.
Les relations entre l’Union et la Biélorussie devraient être fondées sur des valeurs communes, en particulier en ce qui concerne les droits de l’homme, la démocratie et l’État de droit, et il y a lieu de rappeler que la situation en matière de droits de l’homme en République de Biélorussie demeure une source de préoccupation pour l’Union, notamment en ce qui concerne des questions comme la peine de mort, qui devrait être abolie.

Calls on the Philippines, as one of the countries having been granted GSP+ status by the EU, to ensure effective implementation of all the core international conventions relating to human and labour rights, the environment and good governance, as listed in Annex VIII to Regulation (EU) No 978/2012; recognises that the Philippines have strengthened their human rights legislation; calls on the Philippines to continue fostering further progress in the promotion of human rights, including the publication of the National Action Plan for Human Rights, as well as in the elimination of corruption; expresses particular concern with regard to the repression faced by activists who are peacefully campaigning to protect their ancestral lands from the impact of mining and deforestation; recalls that under the GSP+ beneficiaries will have to prove that they are implementing their obligations concerning human rights, labour, environmental and governance standards.

Democracy and human rights are inextricably linked and mutually reinforcing, as recalled in the Council Conclusions of 18 November 2009 on democracy support in the EU's external relations.

Recalls that, with regard to Cuba, the above-mentioned Common Position adopted in 1996 and periodically renewed reflects the roadmap for peaceful transition to democracy, remains fully in force and is not the subject of controversy in the European institutions; regrets that, to date, there has been no significant improvement as regards human rights; notes the Council's decision of 20 June 2008 to lift the informal sanctions with regard to Cuba whilst calling on that country to free all political prisoners immediately and unconditionally, to facilitate access to prisons and to ratify and implement the International Covenant on Civil and Political Rights; notes that the Council will decide in a year's time whether to pursue the political dialogue with Cuba. depending on whether or not there have been significant improvements as regards human rights; recalls that the Council's position is also binding on the European Union institutions as regards dialogue both with the Cuban authorities and with the representatives of civil society; reiterates its position with regard to the Sakharov Prize winners Oswaldo Payá Sardiñas and the group known as "Damas de Blanco" ("Ladies in White");
10. rappelle qu'en ce qui concerne Cuba, la position commune adoptée en 1996, et renouvelée périodiquement, reflète la feuille de route en faveur d'une transition pacifique vers la démocratie, reste pleinement en vigueur et ne fait l'objet d'aucune controverse au sein des institutions européennes; regrette que, jusqu'à présent, aucune amélioration significative en matière de droits de l'homme ne se soit produite; prend note de la décision du Conseil du 20 juin 2008 de lever les sanctions informelles concernant Cuba, tout en demandant la libération immédiate et inconditionnelle de tous les prisonniers politiques, de faciliter l'accès aux prisons et de ratifier et mettre en œuvre le pacte international relatif aux droits civils et politiques; note que le Conseil décidera dans un an s'il poursuit le dialogue politique avec Cuba en fonction de l'existence ou non d'améliorations significatives en matière de droits de l'homme; rappelle que la position du Conseil est également contraignante à l'égard des institutions de l'Union pour le dialogue tant avec les autorités cubaines qu'avec les représentants de la société civile; réitère sa position vis-à-vis des lauréats du prix Sakharov, M. Oswaldo Payá Sardiñas et le groupe appelé "Damas de Blanco" ("Les dames en blanc");

As a general remark, the Commission recalls that the Directive must be interpreted and applied in accordance with fundamental rights[5], in particular the right to respect for private and family life, the principle of non-discrimination, the rights of the child and the right to an effective remedy as guaranteed in the European Convention of Human Rights (ECHR) and as reflected in the EU Charter of Fundamental Rights.

REFERRING to the principles of the Charter of the United Nations, and recalling the Universal Declaration of Human Rights, the conclusions of the 1993 Vienna Conference on Human Rights, the Covenants on Civil and Political Rights and on Economic, Social and Cultural Rights, the Convention on the Rights of the Child, the Convention on the Elimination of all forms of Discrimination against Women, the International Convention on the Elimination of all forms of Racial Discrimination, the 1949 Geneva Conventions and the other instruments of international humanitarian law, the 1954 Convention relating to the status of stateless persons, the 1951 Geneva Convention relating to the Status of Refugees and the 1967 New York Protocol relating to the Status of Refugees.
