TRADUCTIONS EN CONTEXTE

The Opinion of the Venice Commission of the Council of Europe of 15 October 2012 called upon the Hungarian legislator to adopt provisions reinstating the dismissed judges in their previous position without requiring them to go through a re-appointment procedure.
Dans son avis du 15 octobre 2012, la Commission de Venise du Conseil de l’Europe a demandé au législateur hongrois d’adopter des dispositions en vue de réintégrer les juges révoqués à leur précédent poste sans les obliger à passer par une nouvelle procédure de nomination.

The Commission believes that the restrictions introduced by the new Hungarian legislation are contrary to the fundamental principles of freedom of establishment and the freedom to provide services, which are guaranteed by the Treaty on the Functioning of the European Union (Articles 49 and 56 TFEU) and by the Services Directive (Directive 2006/123/EC of the European Parliament and of the Council of 12 December 2006 on services in the internal market).
