1. This Regulation relates to scrutiny of the commercial documents of those entities receiving or making payments relating directly or indirectly to the system of financing by the European Agricultural Guarantee Fund (EAGF), or their representatives, hereinafter ‘undertakings’, in order to ascertain whether transactions forming part of the system of financing by the EAGF have actually been carried out and have been executed correctly.

Council Regulation (EEC) No 4045/89 of 21 December 1989 on scrutiny by Member States of transactions forming part of the system of financing by the Guarantee Section of the European Agricultural Guidance and Guarantee Fund requires Member States to carry out ex-post controls on certain common agricultural policy expenditure of financial year ‘n’ in the period from 1 July n + 1 to 30 June n + 2.

Cooperation shall also provide support to capacity-building, institutional support and participation in the core funding of national and/or regional initiatives to reduce the commercial risks for investors (inter alia guarantee funds, regulatory bodies, arbitration mechanisms and judiciary systems to enhance the protection of investments improving the export credit systems).

La coopération soutient aussi le développement des capacités et apporte un appui institutionnel et une participation au financement de base des initiatives nationales et/ou régionales pour réduire les risques commerciaux encourus par les investisseurs (notamment fonds de garantie, organismes réglementaires, mécanismes d'arbitrage et systèmes judiciaires visant à augmenter la protection des investissements en améliorant les systèmes de crédit à l'exportation).

Whereas Article 5 (2) of Council Regulation (EEC) No 729/70 of 21 April 1970 on the financing of the common agricultural policy (4) provides for a new system of clearance of the accounts of the Guarantee Section of the European Agricultural Guidance and Guarantee Fund; whereas this system comprises the splitting of the old clearance of the accounts into two separate types of decision, one covering the financial clearance of the accounts submitted by the Member States and the other concerning the possible refusal of financing by the Fund of expenditure which was not disbursed in compliance with Community rules; whereas Article 102 of the Financial Regulation of 21 December 1977 applicable to the general budget of the European Communities (5) should be aligned on the new clearance of accounts procedure in order to specify in particular the budgetary treatment of refusals of financing;
considérant que l'article 5, paragraphe 2, du règlement (CEE) n° 729/70 du Conseil du 21 avril 1970 relatif au financement de la politique agricole commune (4) a établi un nouveau système d'apurement des comptes de la section garantie du Fonds européen d'orientation et de garantie agricole; que ce système consiste à éclater l'ancien apurement des comptes en deux types distincts de décisions dont l'un porte sur l'apurement comptable des comptes transmis par les États membres et l'autre sur le refus éventuel de la prise en charge par le Fonds des dépenses qui n'ont pas été effectuées en conformité avec les règles communautaires; que, afin de préciser notamment le traitement budgétaire des décisions de refus, il convient d'adapter l'article 102 du règlement financier du 21 décembre 1977 applicable au budget général des Communautés européennes (5) à la nouvelle structure de l'apurement des comptes;
