10. Calls for a regular review of non-executed EAWs and consideration of whether they, together with the corresponding SIS II and Interpol alerts, should be withdrawn; also calls for the withdrawal of EAWs and the corresponding SIS II and Interpol alerts where the EAW has been refused on mandatory grounds, such as on the ground of ne bis in idem or incompatibility with human rights obligations; calls for provision to be made for SIS II and Interpol alerts to be mandatorily updated with information on the grounds for refusing the execution of the EAW corresponding to the alert and for appropriate updating of Europol files;

Member States shall provide that professionals, in respect of whom alerts are sent to other Member States, are informed in writing of decisions on alerts at the same time as the alert itself, may appeal under national law against the decision or apply for rectification of such decisions and shall have access to remedies in respect of any damage caused by false alerts sent to other Member States, and in such cases the decision on the alert shall be qualified to indicate that it is subject to proceedings by the professional.

Once the system is operational and alerts are included in it, the SIS II will only be possible to store the following information on persons for whom an alert has been issued: surname(s) and forename(s), name(s) at birth, aliases, specific physical characteristics, place and date of birth, sex, photographs, fingerprints, nationality(ies), whether the person concerned is armed, violent or has escaped, reason for the alert, authority issuing the alert, a reference to the decision giving rise to the alert and link(s) to other alerts issued in SIS II. It will also include the action to be taken in the event that there is a “hit” (i.e. if a competent national authority finds an alert in SIS II concerning a non-EU national on whom they have carried out a check).

In case of alerts issued by Member States, SIS II alerts and the exchange of all information on these alerts shall always have priority over alerts and information exchanged via Interpol.
