Definition: This block contains a wide variety of disorders that differ in severity and clinical form but that are all attributable to the use of one or more psychoactive substances, which may or may not have been medically prescribed. Where a market sounding involves the disclosure of inside information, the disclosing market participant will be considered to be acting within the normal course of his employment, profession or duties where, at the time of making the disclosure, he informs and receives the consent of the person to whom the disclosure is made that he may be given inside information; that he will be restricted by the provisions of this Regulation from trading or acting on that information; that reasonable steps must be taken to protect the ongoing confidentiality of the information; and that he must inform the disclosing market participant of the identities of all natural and legal persons to whom the information is disclosed in the course of developing a response to the market sounding.

(Le document est déposé) Question n 68 Mme Kirsty Duncan: En ce qui concerne l'Initiative canadienne de vaccination contre le VIH (l’Initiative) et le laboratoire de niveau 5 (le laboratoire): a) quels sont les détails de la première demande de propositions relative à l’Initiative; b) quel montant d’argent le gouvernement et la Fondation Gates prévoyaient-ils investir dans l’Initiative et quelles étaient les dates prévues pour cet investissement; c) combien y a-t-il eu de soumissions pour cette Initiative et de quels organismes parvenaient-elles; d) quels sont les détails du processus visant à déterminer les candidats choisis pour l’Initiative; e) quels étaient les critères de sélection de la meilleure soumission et qui était chargé de les définir; f) de combien de personnes était constitué le comité d’évaluation indépendant chargé d’étudier les soumissions relatives à l’Initiative, comment ces personnes ont-elles été choisies et de quelles régions et disciplines provenaient-elles; g) des représentants de l’industrie pharmaceutique ont-ils été invités à participer au comité indépendant d’évaluation des soumissions pour l’Initiative, dans l’affirmative, à quelle date chacun d’entre eux y a-t-il participé et, dans la négative, pourquoi ne l’a-t-il pas fait; h) quels ont été les résultats pour chacun des critères de sélection et pour chacun des organismes ayant présenté une soumission dans le cadre de l’Initiative, et comment les soumissions ont-elles été classées; i) le comité indépendant d’évaluation des soumissions relatives à l’Initiative a-t-il effectué une recommandation et, dans l’affirmative, à quelle date l’a-t-il fait et à qui l’information a-t-elle été transmise au sein du gouvernement; j) un comité de direction a-t-il été créé pour les soumissions relatives à l’Initiative et, dans l’affirmative, qui en étaient les membres, qui en assurait la présidence et quel était son mandat; k) des modifications ont-elles été apportées au comité de direction po ...

‘Whereas the Ombudsman, who may also act on his own initiative, must have access to all the elements required for the performance of his duties; whereas to that end Community institutions and bodies are obliged to supply the Ombudsman, at his request, with any information which he requests of them and without prejudice to the Ombudsman's obligation not to divulge such information; whereas access to classified information or documents, in particular to sensitive documents within the meaning of Article 9 of Regulation (EC) No 1049/2001 (5), should be subject to compliance with the rules on security of the Community institution or body concerned; whereas the institutions or bodies supplying classified information or documents as mentioned in the first subparagraph of Article 3(2) should inform the Ombudsman of such classification; whereas for the implementation of the rules provided for in the first subparagraph of Article 3(2), the Ombudsman should have agreed in advance with the institution or body concerned the conditions for treatment of classified information or documents and other information covered by the obligation of professional secrecy; whereas if the Ombudsman finds that the assistance requested is not forthcoming, he shall inform the European Parliament, which shall make appropriate representations;
«considérant que le Médiateur, qui peut également agir de sa propre initiative, doit pouvoir disposer de tous les éléments nécessaires à l’exercice de ses fonctions; que, à cet effet, les institutions et organes communautaires sont tenus de fournir au Médiateur, à sa demande, les renseignements qu’il leur demande et sans préjudice de l’obligation qui incombe au Médiateur de ne pas les divulguer; que l’accès aux informations ou aux documents classifiés, en particulier aux documents sensibles au sens de l’article 9 du règlement (CE) no 1049/2001 (5), devrait être subordonné au respect des réglementations sur la sécurité en vigueur dans l’institution ou l’organe communautaire concerné; que les institutions ou les organes qui transmettent des informations ou des documents classifiés, tels que mentionnés à l’article 3, paragraphe 2, premier alinéa, devraient informer le Médiateur de cette classification; que, pour l’application des dispositions de l’article 3, paragraphe 2, premier alinéa, le Médiateur devrait avoir arrêté au préalable avec l’institution ou l’organe concerné les modalités de traitement des informations ou des documents classifiés et des autres informations couvertes par l’obligation du secret professionnel; que, s’il ne reçoit pas l’assistance souhaitée, le Médiateur en informe le Parlement européen, auquel il appartient d’entreprendre les démarches appropriées;

‘repair information’ means all information required for diagnosis, servicing, inspection, periodic monitoring or repair of the engine and which the manufacturers provide for their authorised dealers/repair shops. Where necessary, such information shall include service handbooks, technical manuals, diagnosis information (e.g. minimum and maximum theoretical values for measurements), wiring diagrams, the software calibration identification number applicable to an engine type, information enabling the update of the software of the electronic systems in accordance with the specifications of the vehicle manufacturer, instructions for individual and special cases, information provided concerning tools and equipment, data record information and two-directional monitoring and test data. The manufacturer shall not be obliged to make available that information which is covered by intellectual property rights or constitutes specific know-how of manufacturers and/or OEM suppliers; in this case the necessary technical information shall not be improperly withheld;
«informations de réparation», toutes les informations nécessaires au diagnostic, à l’entretien, au contrôle, à la révision périodique ou à la réparation du véhicule et mises par les constructeurs à la disposition de leurs revendeurs/garages agréés; ces informations incluent, au besoin, les manuels d’entretien, les instructions techniques, les données relatives au diagnostic (par exemple: valeurs minimales et maximales théoriques pour les mesures), les plans de montage, le numéro d’identification de l’étalonnage par logiciel applicable à un type de moteur, les données permettant la mise à jour du logiciel conformément aux spécifications du constructeur du véhicule, les instructions pour les cas individuels et spéciaux, les informations communiquées sur les outils et les appareils, les informations sur le contrôle des données, et les données d’essai et de contrôle bidirectionnelles; le constructeur n’est pas tenu de fournir les informations qui font l’objet de droits de propriété intellectuelle ou constituent un savoir-faire spécifique des fabricants et/ou des fournisseurs de l’équipement d’origine (OEM); dans ce cas, les informations techniques nécessaires ne sont pas refusées de façon abusive;

‘confidential information’ shall mean: (a) all non-public information regarding the proceedings and deliberations of the Procurement Committee; (b) all information contained in tender documents submitted by printing works and/or other third parties to the Procurement Committee; (c) all information which consists of trade secrets or other confidential or proprietary technical and/or business information related to euro banknote production; (d) information contained in the technical specifications for each euro banknote denomination; and (e) any other information regarding euro banknote production which is marked confidential or which by its nature a reasonable person would deem confidential;
«informations confidentielles»: a) toutes les informations non publiques concernant les réunions et les délibérations du comité d’attribution; b) toutes les informations contenues dans les offres présentées au comité d’attribution par les imprimeries ou des tiers; c) toutes les informations consistant en des secrets commerciaux ou en d’autres informations techniques ou commerciales, confidentielles ou exclusives, relatives à la production des billets en euros; d) les informations contenues dans les spécifications techniques pour chaque dénomination des billets en euros, et e) toute autre information concernant la production des billets en euros, qualifiée de confidentielle, ou qu’une personne raisonnable considérerait comme confidentielle par nature;
