In this respect, it should be noted that, in accordance with the general principle of equality of treatment embodied in Community law, Member States which impose penal sanctions for infringement of a national patent must ensure equivalent protection in cases of infringement of the Community patent.

(3) To that end it is essential to approximate existing legal provisions, in particular, on the one hand, the precise definition of the infringement in question and the cases of exemption, which is the subject of this Directive and, on the other hand, minimum rules for penalties, liability of legal persons and jurisdiction, which is the subject of Council framework Decision 2002/946/JHA of 28 November 2002 on the strengthening of the penal framework to prevent the facilitation of unauthorised entry, transit and residence(3).
(3) Dans cette perspective, il est essentiel de parvenir à un rapprochement des dispositions juridiques existantes, notamment en ce qui concerne, d'une part, la définition précise de l'infraction considérée et des exemptions, qui fait l'objet de la présente directive, et, d'autre part, les règles minimales en matière de sanctions, de responsabilité des personnes morales et de compétence, qui font l'objet de la décision-cadre 2002/946/JAI du Conseil du 28 novembre 2002 visant à renforcer le cadre pénal pour la répression de l'aide à l'entrée, au transit et au séjour irréguliers(3).
