TRADUCTIONS EN CONTEXTE

This approach will meet a concern for efficiency -- more rapid and effective intervention including where proceedings for failure to fulfil an obligation would not be the most appropriate mechanism -- while ensuring equal treatment for the Member States and for the different channels for identifying presumed infringements (complaints, cases identified by the Commission itself, cases referred by the European Parliament or the European Ombudsman).

The high number of infringements, complaints and petitions in the area of the environment shows the need for an effective, workable system of checks and balances at national level to help to identify and resolve implementation problems, along with measures to prevent them from arising in the first place, such as liaison between the relevant administrations responsible for implementation and experts during the policy development phase.

Where another supervisory authority should act as a lead supervisory authority for the processing activities of the controller or processor but the concrete subject matter of a complaint or the possible infringement concerns only processing activities of the controller or processor in the Member State where the complaint has been lodged or the possible infringement detected and the matter does not substantially affect or is not likely to substantially affect data subjects in other Member States, the supervisory authority receiving a complaint or detecting or being informed otherwise of situations that entail possible infringements of this Regulation should seek an amicable settlement with the controller and, if this proves unsuccessful, exercise its full range of powers.

Q. whereas the Ombudsman made a draft recommendation to the Commission, urging it to ‘reconsider its approach as regards the handling of the complainants’ infringement complaint concerning Vienna airport and address the deficiencies highlighted by the Ombudsman’ and pointing out that this meant ‘that the Commission’s further actions in the infringement proceedings should take into account the obligation of the national authorities to ensure that (i) the complainants have access to a review procedure and (ii) steps are taken to deal with a manifest conflict of interest in the application of Directive 85/337’;

The Commission should correct its approach as regards the handling of the complainants’ infringement complaint concerning Vienna airport, address the deficiencies highlighted by the Ombudsman in his decision of 2 December 2009 on complaint 1532/2008 and conclude its assessment as rapidly as possible.
