This Regulation lays down rules concerning the application of financial penalties to the holders of marketing authorisations, granted under Regulation (EC) No 726/2004, in respect of infringements of the following obligations, in cases where the infringement concerned may have significant public health implications in the Union, or where it has a Union dimension by taking place or having its effects in more than one Member State, or where interests of the Union are involved:

Le présent règlement fixe des règles pour l’application de sanctions financières aux titulaires d’autorisations de mise sur le marché octroyées en vertu du règlement (CE) no 726/2004 en ce qui concerne les infractions aux obligations suivantes, lorsque l'infraction concernée peut avoir d'importantes conséquences pour la santé publique au niveau de la Communauté, lorsqu’elle revêt une dimension communautaire parce qu’elle a lieu ou déploie ses effets dans plus d’un État membre, ou lorsque les intérêts communautaires sont en jeu:

(1)the obligation to submit complete and accurate particulars and documents in an application for marketing authorisation under Regulation (EC) No 726/2004 submitted to the European Medicines Agency established by that Regulation, (hereinafter ‘the Agency’), or in response to obligations laid down in that Regulation and Regulation (EC) No 1901/2006 to the extent that the infringement concerns a material particular.
1)l’obligation de fournir des renseignements et des documents exhaustifs et exacts dans une demande d’autorisation de mise sur le marché présentée en vertu du règlement (CE) no 726/2004 à l’Agence européenne des médicaments instituée par ledit règlement (ci-après «l’Agence»), ou en exécution des obligations prévues par ledit règlement et le règlement (CE) no 1901/2006, dans la mesure où l’infraction porte sur un point important.

Where another supervisory authority should act as a lead supervisory authority for the processing activities of the controller or processor but the concrete subject matter of a complaint or the possible infringement concerns only processing activities of the controller or processor in the Member State where the complaint has been lodged or the possible infringement detected and the matter does not substantially affect or is not likely to substantially affect data subjects in other Member States, the supervisory authority receiving a complaint or detecting or being informed otherwise of situations that entail possible infringements of this Regulation should seek an amicable settlement with the controller and, if this proves unsuccessful, exercise its full range of powers.
Lorsqu'une autre autorité de contrôle devrait faire office d'autorité de contrôle chef de file pour les activités de traitement du responsable du traitement ou du sous-traitant mais que l'objet concret d'une réclamation ou la violation éventuelle ne concerne que les activités de traitement du responsable du traitement ou du sous-traitant dans l'État membre dans lequel la réclamation a été introduite ou dans lequel la violation éventuelle a été constatée et que la question n'affecte pas sensiblement ou n'est pas susceptible d'affecter sensiblement des personnes concernées dans d'autres États membres, l'autorité de contrôle qui est saisie d'une réclamation, ou qui constate des situations susceptibles de constituer des violations du présent règlement ou qui est informée d'une autre manière de telles situations devrait rechercher un règlement amiable avec le responsable du traitement et, en cas d'échec, exercer l'ensemble de ses pouvoirs.

6. The sanctions laid down in this Regulation shall be subject to a limitation period of 5 years as of the day the infringement concerned was committed or, in the case of continuing or repeated infringements, the date on which the infringements ceased.
6. Les sanctions fixées dans le présent règlement font l'objet d'une période de limitation de 5 ans à compter de la date à laquelle l'infraction concernée a été commise ou, dans le cas d'infractions persistantes ou répétées, la date à laquelle les infractions ont cessé.

7. Any immediate measures taken by the competent authorities shall be of such nature as to prevent the continuation of the infringement concerned and to allow the competent authorities to complete their investigation.

(b) the most serious degree of infringement concerns those which create a serious risk of fatalities or serious injuries;

Instead, it would have been more useful to limit the scope of the directive just to copyright infringements concerning the commercial production of counterfeit multimedia products, an area in which organised crime operates.
