IN-CONTEXT TRANSLATIONS

In its annual reports on monitoring the application of Community law, the Commission has regularly acknowledged the vital role played by the complainant in detecting infringements of Community law, compliance with which it ensures on the basis of, inter alia, the infringement procedure laid down by Article 226 of the Treaty establishing the European Community and Article 141 of the Treaty establishing the European Atomic Energy Community.
Dans le cadre de ses rapports annuels sur le contrôle de l'application du droit communautaire, la Commission a, à plusieurs reprises, reconnu le rôle essentiel du plaignant dans la détection des infractions au droit communautaire, dont elle assure le respect notamment au moyen de la procédure en manquement visée à l'article 226 du traité instituant la Communauté européenne et à l'article 141 du traité instituant la Communauté européenne de l'énergie atomique.

In a Communication to the European Parliament and European Ombudsman on relations with the complainant in respect of infringements of Community law (COM(2002) 141 final), the Commission confirmed its willingness to handle all complaints from citizens, by taking action, where appropriate, against the alleged infringement.

5. Strongly disapproves of the fact that the Commission's report fails to recognise the important role played by the petitions process in detecting infringements of Community law; in this respect, regards the statistics annexed to the report, which show the origin of infringements, as grossly misleading, since the total number of complaints made to the Commission is compared merely with the number of petitions that actually lead to the opening of an infringement procedure;

(b) within the framework of Title VI of the Treaty on European Union, customs cooperation seeks to suppress customs offences. This involves detecting, investigating and prosecuting infringements of national customs law and prosecuting and punishing infringements of Community law, particularly by means of criminal proceedings.

Has the Commission asked for the Greek authorities to modify this formula, and what measures have been taken in respect of accusations of infringements of Community law and to address the issue of the exceptionally low tenders for public contracts?

This communication on relations with the complainant in respect of infringements of Community law is an example of the Commission’s commitment to publishing in consolidated form all internal Commission rules governing the procedures applicable to relations with complainants in connection with the infringement procedure.
Cette communication concernant les relations avec le plaignant en matière d'infractions au droit communautaire est un exemple de l'engagement pris par la Commission européenne de publier de manière consolidée l'ensemble de ses règles internes de procédures applicables aux relations avec le plaignant dans le cadre de la procédure en manquement.
