In the interest of legal certainty and to adequately address conflicts of interests when deciding to suspend or to remove financial instruments from trading, it should be ensured that if an investment firm or a market operator operating a trading venue stops trading due to non-compliance with their rules, the others follow that decision if it is decided so by their competent authorities unless continuing trading may be justified due to exceptional circumstances.
Dans un souci de sécurité juridique et pour permettre la résolution adéquate des conflits d’intérêts, il convient de s’assurer que, si une entreprise d’investissement ou un opérateur de marché exploitant une plate-forme de négociation décide de suspendre la négociation d’un instrument financier ou de le retirer au motif qu’il ne respecte pas leurs règles, les autres plates-formes prennent la même décision si leurs autorités compétentes le décident, à moins que des circonstances exceptionnelles ne justifient la poursuite de la négociation.

Where the suspension or removal is due to the non-disclosure of information about the issuer or financial instrument, the relevant competent authority in the meaning of point (7) of Article 2 of Commission Regulation (EC) No 1287/2006 shall require that other regulated markets, MTFs and OTFs and any other trading arrangement trading the same financial instrument shall also suspend or remove that financial instrument from trading as soon as possible .
