With a view to strengthening the protection of retail investors, this Regulation in addition provides that for retail investors whose portfolio, composed of cash deposits and financial instruments excluding any financial instruments that have been given as collateral, does not exceed EUR 500 000, the manager of the ELTIF or any distributor, after having performed a suitability test and having provided appropriate investment advice, should ensure that the retail investor does not invest an aggregate amount exceeding 10 % of the investor's portfolio in ELTIFs and the initial amount invested in one or more ELTIFs is not less than EUR 10 000.
Afin de renforcer la protection des investisseurs de détail, le présent règlement dispose, en outre, que pour les investisseurs de détail dont le portefeuille, composé de dépôts bancaires et d'instruments financiers, à l'exclusion de tout instrument financier qui a été donné en garantie, ne dépasse pas 500 000 EUR, le gestionnaire de l'ELTIF ou le distributeur, après avoir procédé à un test de pertinence et avoir fourni des conseils d'investissement appropriés, devrait s'assurer que l'investisseur de détail n'investit pas un montant total supérieur à 10 % de son portefeuille dans des ELTIF et que le montant initial placé dans un ou plusieurs ELTIF n'est pas inférieur à 10 000 EUR.

3. Where the financial instrument portfolio of a potential retail investor does not exceed EUR 500 000, the manager of the ELTIF or any distributor, after having performed the suitability test referred to in Article 28(1) and having provided appropriate investment advice, shall ensure, on the basis of the information submitted by the potential retail investor, that the potential retail investor does not invest an aggregate amount exceeding 10 % of that investor's financial instrument portfolio in ELTIFs and that the initial minimum amount invested in one or more ELTIFs is EUR 10 000.
3. The key investor information document of a fund of funds should therefore be prepared on the basis that the investor does not wish or need to be informed in detail about the individual features of each of the underlying collectives, which in any case are likely to vary from time to time if the UCITS is being actively managed.

As regards the provisions on disclosure, the Commission should be empowered to adopt measures designed to specify the specific conditions to be met when the prospectus is provided in a durable medium other than paper or by means of a website which does not constitute a durable medium, the detailed and exhaustive content, form and presentation of the key investor information taking into account the different nature or components of the UCITS concerned, and the specific conditions for providing key investor information in a durable medium other than paper or by means of a website which does not constitute a durable medium.

This Directive provides that certain categories of professional and institutional investor can be exempted from the scope of mandatory investor protection schemes provided for in the Directive (Article 4(2)) "if it does not consider that they need special protection from the cover afforded by investor-compensation schemes" (recital 17).The Investor Compensation Scheme Directive clearly revolves around the "need for protection" philosophy.
