WHEREAS the St. Regis band of Indians situated at the village of St. Regis, in the township of Dundee, county of Huntingdon, in the province of Quebec, hold certain islands in the river St. Lawrence, between the town of Prescott and the village of Lancaster, as part of their Reserve; and whereas over a century ago the chiefs and headmen of the said band purported to grant leases of a number of the said islands, or portions of islands, in consideration of a nominal rental, for terms of ninety-nine years with covenants for renewals of the said leases for further periods of ninety-nine years; and whereas in the interest of the Indians of the said band, the Crown has taken action in the courts to have these alleged leases declared null and void and has already succeeded in recovering what are known as Lewis island, Snyder island and Thompson or Macmaster island; and whereas actions are still pending in respect of Thomas or Hamilton island, and what is known as the Easterbrook farm on Cornwall island; and whereas it is considered that the revenues to be derived from these islands maintained in their scenic beauty and leased for summer resorts or agricultural purposes, would be of much greater benefit to the band than they would derive from having these islands thrown open to the Indians generally resulting in the groves of timber being cut down and removed for firewood, as has happened with many other islands, rendering them non-productive as summer resorts: Therefore His Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:—

In the Gulf of St. Lawrence; east of the locality of La Romaine and near the hamlet of Baie des Loups (in latitude approximately 50°10′N and in longitude approximately 60°18′W); all this parcel of land including Outer Islet, Wolf Island, Emery Island and all the other unnamed islands, the rocks and water within an irregular area, the boundaries of which can be described as follows: on the north, the boundary is located midway between the firm land and the nearest islands and islets and measures approximately six kilometres; on the east, the boundary is located approximately 1.5 kilometres from a group of unnamed islands located approximately four kilometres north of Wolf Island and 1.5 kilometres east of Wolf Island and Outer Islet; to the south and west, this boundary is located approximately 1.5 kilometres from the said Outer Islet and Wolf Island, continuing northward along the river, passing west of Emery Point and the islets located there until it reaches the said northern boundary; the whole as shown on a plan prepared by the Real Estate Services of the Department of Public Works Canada, number MM-82-5400.

The waters of the North Channel of Lake Huron, lying northerly and easterly of the international boundary between Canada and the United States, Cockburn Island and Manitoulin Island in the Territorial District of Maintoulin to the west boundary of Division 16, including the waters of False Detour Channel lying between Drummond Island and Cockburn Island, and the waters of the St. Marys River downstream from the gates of the Compensating Works, from the lower lock of the Sault Ste. Marie Canal National Historic Site of Canada, and from the outflow of the Hydro-electric Power Generation Station, at the city of Sault Ste. Marie, excepting the waters of St. Joseph Island.

The amount of aid shall be fixed taking into consideration the additional costs of marketing products in the smaller islands, calculated from the usual ports of shipment in mainland Greece, and from the ports of islands of transit or of loading for the islands of final destination.

(14) Tobacco growing is of historical importance on the islands. Economically speaking, tobacco preparation continues to be one of the chief industrial activities in the region. In social terms, tobacco cultivation is very labour intensive and carried out by small farms. Since the crop is not sufficiently profitable it is in danger of dying out. Tobacco is currently cultivated only on a small area on the island of La Palma, where it is used for the artisanal manufacture of cigars. Spain should therefore be authorised to continue to grant aid in addition to the Community aid so that this traditional crop can be maintained with a view to supporting the artisanal activity associated with it. In addition, to maintain the manufacture of tobacco products, imports into the Canary Islands of raw and semi-manufactured tobacco should continue to be exempt from customs duty, up to an annual limit of 20000 tonnes of stripped raw tobacco equivalent.
(14) La culture du tabac a été historiquement très importante dans l'archipel; sur le plan économique, c'est une industrie d'élaboration qui continue à représenter une des principales activités industrielles de la région; sur le plan social, cette culture est très intensive en main d'oeuvre et concerne de petits agriculteurs; cette culture manque d'une rentabilité adéquate et court le risque de disparaître; en effet à l'heure actuelle, sa production se limite à une petite superficie sur l'île de La Palma pour l'élaboration artisanale de cigares; il convient donc d'autoriser l'Espagne à continuer à accorder une aide en complément de l'aide communautaire afin de permettre le maintien de cette culture traditionnelle et l'activité artisanale dont elle est le support; en outre, et pour maintenir l'activité industrielle de la fabrication de produits de tabac, il convient de continuer à exonérer des droits de douane à l'importation dans l'archipel de tabacs bruts et semi-élaborés, dans la limite d'une quantité annuelle de 20000 tonnes d'équivalent de tabac brut écoté.

4. Where marketing of the products referred to in paragraph 1 of this Article is undertaken by joint ventures constituted, with the aim of marketing produce from the Canary Islands, by producers in those islands or producer organisations as referred to in Articles 11, 13 and 14 of Regulation (EC) No 2200/96 and natural or legal persons established in the rest of the Community, and where the partners undertake to pool the knowledge and know-how required to achieve the objective of the joint venture over a minimum period of three years, the amount of the aid shall be increased to 13 % of the value of the annual production marketed jointly.
4. Lorsque la commercialisation des produits visés au paragraphe 1 du présent article est effectuée par des entreprises communes qui associent, dans le but de commercialiser les productions canariennes, des producteurs de ces îles ou des organisations de producteurs visées aux articles 11, 13 et 14 du règlement (CE) n° 2200/96 et des personnes physiques ou morales établies dans le reste de la Communauté et que les partenaires s'engagent à mettre en commun les connaissances et le savoir-faire nécessaires à la réalisation de l'objet de l'entreprise pendant une durée minimale de trois ans, le montant de l'aide est porté à 13 % de la valeur de la production commercialisée annuellement en commun.
