The Japanese firms involved are: Electronic typewriters: Brother, Canon, Matsushita, Sharp, TEC Tokyo Electric (a subsidiary of Toshiba) and Silver Seiko Weighing scales: TEC Tokyo Electric If the Commission finds in its investigations that the conditions of new anti-dumping legislation have been fulfilled by any of these firms, then the anti-dumping duties which are applied to the complete imported products could equally be levied on the components imported from Japan.
Les sociétés japonaises concernées sont : - pour les machines à écrire électroniques : Brother, Canon, Matsushita, Sharp, TEC Tokyo Electric (filiale de Toshiba) et Seiko ; - pour les balances : TEC Tokyo Electric. Si les enquêtes menées par la Commisison font apparaître que les conditions prévues par la nouvelle législation antidumping sont remplies par une de ces firmes, les droits antidumping qui s'appliquent aux produits importés complets pourraient également être perçus sur les pièces composantes importées du Japon.

- 2 - As a result of the investigation, which covered the period from 1 January to 31 July 1987, it transpired that all these firms except Brother Industries .the two criteria for action under the new anti-dumping Regulation, namely: - they had begun their operations in the Community after the opening of the anti-dumping investigation, - they used a very high proportion of components ranging on average from 75% to 96% from the Japanese companies which were the subject of the original anti-dumping duty. Accordingly the Commission is proposing to the Council that anti- dumping duties should be imposed on the products manufactured by these firms, set at the following levels for each assembled part: - Canon Bretagne (France) 44.00 ECU - Kyushu Matsushita (UK) 40.94 ECU - Sharp (UK) 21.82 ECU - Silver Reed (UK) 56.14 ECU However, for Brothers industries UK the investigation snowed that on average less than 60% of the parts used came from Japan and therefore an anti-dumping duty could not be imposed.
- 2 - A l'issue de l'enquête qui a porté sur la période du 1er janvier 1987 au 31 juillet 1987, il est apparu que pour toutes ces sociétés, à l'exception de Brother Industries les deux critères d'application du nouveau règlement antidumping étaient présents, à savoir : - les sociétés en question avaient débuté leurs opérations dans la Communauté après l'ouverture de l'enquête antidumping; - elles utilisaient une proportion très élevée de composants en provenance des sociétés japonaises frappées du droit antidumping originel, proportion variant en moyenne entre 75 et 96%; C'est la raison pour laquelle la Commission propose au Conseil l'imposition de droits antidumping sur les produits manufacturés par ces entreprises, droits qui seront fixés au niveau suivant par pièce assemblée : - Canon Bretagne (F) 44.00 Ecus - Kyushu Matsushita (RU) 40,94 Ecus - Sharp (RU) 21.82 Ecus - Silver Reed (RU) 56.14 Ecus Par contre, pour la firme Brother Industries (RU), il a été constaté que la moyenne des composants utilisés en provenance du Japon était inférieure à 60% et qu'elle ne pouvait, par conséquent, faire l'objet d'un droit antidumping.

In December 1984, at the end of its preliminary investigation, the Commission, having established that the Japanese firms were dumping and that this was causing injury to the European industry, imposed provisional anti-dumping duties ranging from 6.9% to 43.7% on imports of Japanese typewriters.
En decembre 1984, a la fin de son enquete preliminaire, la Commission, apres avoir constate que les entreprises japonaise pratiquaient le dumping et que cette pratique causait un prejudice a l'industrie europeenne, a impose des droits anti-dumping provisoires allant de 6,9 % a 43,7 % sur les importations de machines a ecrire japonaises.

Following the adoption by the Council of the European Communities of an amendment to Community anti-dumping legislation, the sole aim of which is to prevent the circumvention of legislation already in force, the Japanese Minister for Trade and Industry, Mr Tamura, expressed the view of his country's authorities that this decision endangers Japanese investment in the Community, and said that Japan was considering appropriate action to be taken against the Community.
Au lendemain de l'adoption par le Conseil des Ministres de la Communaute d'une modification de la legislation communautaire anti-dumping, dont l'objectif unique est d'eviter le contournement de la legislation en vigueur, les autorites japonaises ont par la voix de Mr TAMURA, Ministre de l'industrie et du commerce estime que cette decision mettait en peril les investissements japonais dans la Communaute et que le Japon envisageait des actions appropriees contre la Communaute.
