Comme il a déjà été souligné au point 9.1. de la Communication du 26 juillet 2000 susmentionnée, deux types d'intérêt doivent être conciliés dans le domaine de la reconnaissance mutuelle de peines d'emprisonnement: l'intérêt de l'État membre où la peine a été prononcée à la faire exécuter et l'intérêt de la personne condamnée à avoir une chance réelle de réinsertion dans la société.

In this area, two sets of interests have to be accommodated: the interest of the Member State where the sentence was pronounced to have it enforced, and the interest of the person convicted to have a realistic chance of reintegration into society [20].

(21) Whereas, in the interests of transparency and legal certainty, it is appropriate to give public information on Commission decisions while, at the same time, maintaining the principle that decisions in State aid cases are addressed to the Member State concerned; whereas it is therefore appropriate to publish all decisions which might affect the interests of interested parties either in full or in a summary form or to make copies of such decisions available to interested parties, where they have not been published or where they have not been published in full; whereas the Commission, when giving public information on its decisions, should respect the rules on professional secrecy, in accordance with Article 214 of the Treaty;
(21) considérant qu'il importe, aux fins de la transparence et de la sécurité juridique, d'assurer la publicité des décisions de la Commission, tout en maintenant le principe selon lequel les décisions en matière d'aides d'État sont adressées à l'État membre concerné; qu'il convient, par conséquent, de publier toutes les décisions qui sont de nature à affecter les intérêts des parties intéressées, soit intégralement, soit sous forme résumée, ou de tenir à leur disposition des copies de ces décisions lorsque celles-ci n'ont pas été publiées ou n'ont pas été publiées intégralement; que la Commission, quand elle publie ses décisions, doit respecter les règles du secret professionnel, conformément à l'article 214 du traité;
