TRADUCTIONS EN CONTEXTE

In view of the conclusions reached with regard to the failure of the Comoros to discharge its duties under international law as flag, port, coastal or market State and to take action to prevent, deter and eliminate IUU fishing, that country should be notified, in accordance with Article 32 of the IUU Regulation, of the possibility of being identified by the Commission as a non-cooperating third country in fighting IUU fishing.
Compte tenu des conclusions énoncées en ce qui concerne le non-respect par les Comores des obligations que leur impose le droit international en leur qualité d’État du pavillon, d’État du port, d’État côtier ou d’État de commercialisation ainsi que leur incapacité à prendre des mesures pour prévenir, décourager et éradiquer la pêche INN, il convient de notifier à ce pays, conformément à l’article 32 du règlement INN, la possibilité qu’il soit recensé par la Commission comme pays tiers non coopérant dans le cadre de la lutte contre la pêche INN.

The abovementioned termination of demarches does not preclude the Commission or the Council from taking any subsequent step in the future, if factual elements reveal that the country fails to discharge the duties incumbent upon it under international law as flag, port, coastal or market State to take action to prevent, deter and eliminate IUU fishing.

In the given circumstances and after examining the above mentioned considerations, the Commission therefore concludes that the demarches vis-à-vis Papua New Guinea pursuant to the provisions of Article 32 of the IUU Regulation with respect to the discharge of their duties incumbent upon them under international law as flag, port, coastal or market State and their actions to prevent, deter and eliminate IUU fishing are hereby terminated.
Dans ces circonstances, et après examen des considérations susmentionnées, la Commission conclut par conséquent que les démarches entreprises à l’égard de l’État indépendant de Papouasie - Nouvelle-Guinée en application des dispositions de l’article 32 du règlement INN en ce qui concerne l’exécution des obligations relatives aux mesures visant à prévenir, à décourager et à éradiquer la pêche INN que lui impose le droit international en sa qualité d’État du pavillon, d’État du port, d’État côtier ou d’État de commercialisation sont désormais terminées.

4. Where the suspected breach has taken place in the high seas, the port Member State shall cooperate with the flag State in carrying out an investigation into it and, where appropriate, shall apply the sanctions provided for by the legislation of that port Member State, under the condition that, in accordance with international law, that flag State has expressly agreed to transfer its jurisdiction.

The failure by some States to discharge the duty incumbent on them under international law as flag, port, coastal or market States, to take appropriate measures to ensure compliance by their fishing vessels or nationals with rules on the conservation and management of fisheries resources is one of the main drivers of IUU fishing and should be addressed by the Community.

3. A third country may be identified as a non-cooperating third country if it fails to discharge the duties incumbent upon it under international law as flag, port, coastal or market State, to take action to prevent, deter and eliminate IUU fishing.
