Regarding the particular lawyer of that law firm, to which complainant 3 has referred in its complaint, Germany has also explained the following: (a) that lawyer worked for the Land from May 2012 until April 2013, i.e. before the initiation of the tender process in June 2013; (b) that lawyer was not in any contact with the Land or the Federal Republic of Germany during the tender process; (c) that lawyer never advised the Land or the sellers in relation to the bidding process; and (d) the same lawyer only participated as an independent expert in the hearing of the Land's parliament on 20 June 2013 concerning the law for the public access to the Nürburgring racetrack.

26. These two guides should be more widely promoted by national authorities. This could be complemented by actions to promote training and information campaigns for the public bodies and professions involved in legal aid (lawyers, judges, police officers, immigration services, etc.) and by support measures for lawyers who agree to work under the legal aid system.

Consequently, an in-house lawyer is less able to deal effectively with any conflicts between his professional obligations and the aims of his client.

For activities relating to the representation or defence of a client in legal proceedings, lawyers who have qualified outside of the country in question may be required to work in conjunction with a local lawyer.

(10) Whereas lawyers covered by this Directive should be permitted to give legal advice in particular on the law of their home Member States, on Community law, on international law and on the law of the host Member State; whereas this is already allowed as regards the provision of services under Council Directive 77/249/EEC of 22 March 1977 to facilitate the effective excercise by lawyers of freedom to provide services (5); whereas, however, provision should be made, as in Directive 77/249/EEC, for the option of excluding from the activities of lawyers practising under their home-country professional titles in the United Kingdom and Ireland the preparation of certain formal documents in the conveyancing and probate spheres; whereas this Directive in no way affects the provisions under which, in every Member State, certain activities are reserved for professions other than the legal profession; whereas the provision in Directive 77/249/EEC concerning the possibility of the host Member State to require a lawyer practising under his home-country professional title to work in conjunction with a local lawyer when representing or defending a client in legal proceedings should also be incorporated in this Directive; whereas that requirement must be interpreted in the light of the case law of the Court of Justice of the European Communities, in particular its judgment of 25 February 1988 in Case 427/85, Commission v. Germany (6);
(10) considérant qu'il convient de permettre aux avocats bénéficiaires de la présente directive de donner des consultations juridiques, notamment dans le droit de l'État membre d'origine, en droit communautaire, en droit international et dans le droit de l'État membre d'accueil; que ceci était déjà, pour la prestation de services, permis par la directive 77/249/CEE du Conseil du 22 mars 1977 tendant à faciliter l'exercice effectif de la libre prestation des services par les avocats (5); que, cependant, il convient de prévoir, comme dans la directive 77/249/CEE, la faculté d'exclure des activités des avocats exerçant sous leur titre professionnel d'origine au Royaume-Uni et en Irlande, certains actes en matière immobilière et successorale; que la présente directive n'affecte en rien les dispositions qui, dans tout État membre, réservent certaines activités à des professions autres que celle d'avocat; qu'il convient également de reprendre de la directive 77/249/CEE la faculté pour l'État membre d'accueil d'exiger que l'avocat exerçant sous son titre professionnel d'origine agisse de concert avec un avocat local pour la représentation et la défense d'un client en justice; que l'obligation d'agir de concert s'applique conformément à l'interprétation qu'en a donnée la Cour de justice des Communautés européennes, notamment dans son arrêt rendu le 25 février 1988 dans l'affaire 427/85 (Commission contre Allemagne) (6);

3. For the pursuit of activities relating to the representation or defence of a client in legal proceedings and insofar as the law of the host Member State reserves such activities to lawyers practising under the professional title of that State, the latter may require lawyers practising under their home-country professional titles to work in conjunction with a lawyer who practises before the judicial authority in question and who would, where necessary, be answerable to that authority or with an 'avoué` practising before it.
3. Pour l'exercice des activités relatives à la représentation et à la défense d'un client en justice et dans la mesure où le droit de l'État membre d'accueil réserve ces activités aux avocats exerçant sous le titre professionnel de cet État, ce dernier peut imposer aux avocats exerçant sous leur titre professionnel d'origine d'agir de concert soit avec un avocat exerçant auprès de la juridiction saisie et qui serait responsable, s'il y a lieu, à l'égard de cette juridiction, soit avec un «avoué» exerçant auprès d'elle.
