The analysis made in this Report, in the context of assessing the impact of existing relevant national legislation, as per Article 23(2) of the Directive, demonstrates a rather diverse legal landscape which fails to effectively contribute to discouraging demand of such services.
L’analyse effectuée dans le présent rapport, dans le cadre de l’évaluation de l’incidence des législations nationales en vigueur, conformément à l’article 23, paragraphe 2, de la directive, montre un paysage juridique assez hétérogène qui ne contribue pas efficacement à décourager la demande de tels services.

8. Reiterates that the entry into force of the Treaty of Lisbon on 1 December 2009 has fundamentally changed the legal landscape of the Union, which should establish itself increasingly as a community of shared values and principles; recalls that the new, multi-level Union system of fundamental rights protection emanates from multiple sources and is enforced through a variety of mechanisms, including the legally binding Charter, the rights guaranteed by the Convention for the Protection of Human Rights and Fundamental Freedoms (ECHR), and the rights based on the Member States' constitutional traditions and their interpretation according to the jurisprudence of the European Court of Human Rights and the CJEU; underlines that this enhanced human rights architecture and high level of protection that the Union is pursuing (‘the European model’) must be also upheld in its external dimension as the Union must be ‘exemplary’ in matters of fundamental rights and should not be perceived as allowing ‘fundamental rights laundering’;
8. réaffirme que l'entrée en vigueur du traité de Lisbonne, le 1 décembre 2009, a modifié fondamentalement le paysage juridique de l'Union, qui devrait se positionner de plus en plus comme une communauté de valeurs et de principes communs; rappelle que le nouveau système à niveaux multiples de l'Union en matière de protection des droits fondamentaux émane de sources différentes et s'applique par l'intermédiaire de mécanismes divers, y compris la Charte, juridiquement contraignante, les droits garantis par la Convention européenne de sauvegarde des droits de l'homme et des libertés fondamentales (CEDH), ainsi que les droits fondés sur les traditions constitutionnelles des États membres et leur interprétation en fonction de la jurisprudence de la Cour européenne des droits de l'homme et de la CJUE; insiste sur le fait que cette architecture renforcée des droits de l'homme ainsi que le niveau élevé de protection auquel l'Union aspire (le "modèle européen") doivent également présider aux activités extérieures de l'Union, dans la mesure où celle-ci doit se montrer "exemplaire" en matière de droits fondamentaux et ne pas donner l'impression d'autoriser le "blanchiment" de ces droits;

Welcomes the main initiatives taken by the Commission, at Parliament’s request, to shape a new EU legislative landscape for anti-fraud policy, and in particular the proposal for a directive on the fight against fraud to the Union’s financial interests by means of criminal law, which aims to clarify and harmonise Member States’ provisions in criminal law on offences related to the EU budget (COM(2012)0363), the proposal for a Council regulation on the establishment of the European Public Prosecutor’s Office (COM(2013)0534), and the proposal for a regulation on the European Union Agency for Criminal Justice Cooperation (Eurojust) (COM(2013)0535), as well as the amendment to Regulation (EC) No 1073/1999 concerning investigations conducted by the European Anti-Fraud Office (OLAF) and stronger legal rights for persons concerned by OLAF investigations; recognises the importance for these different pieces of legislation to be well calibrated and thoroughly evaluated; calls on the Council to take the necessary time and not to finalise negotiations in a rush, in order to develop a robust European legal framework and strengthen the existing institutional tools for protecting the Union’s financial interests; stresses that a premature transition to the enhanced cooperation procedure should be avoided; welcomes also the action plan to step up the fight against tax fraud and tax evasion, as well as VAT reform in the EU, both efforts having been initiated in 2011;
5. salue les principales initiatives menées par la Commission, à la demande du Parlement européen, en vue de la définition d'un nouveau paysage législatif européen en matière de politique anti-fraude et, en particulier, la proposition de directive relative à la lutte contre la fraude portant atteinte aux intérêts financiers de l'Union au moyen du droit pénal visant à clarifier et harmoniser le droit pénal des États membres concernant les infractions relatives au budget de l'UE (COM(2012)0363), la proposition de règlement du Conseil portant création du Parquet européen (COM(2013)0534) et la proposition de règlement relatif à l'Agence européenne de coopération judiciaire en matière pénale EUROJUST (COM (2013)0535) ainsi que la modification au règlement (CE) n° 1073/1999 relatif aux enquêtes de l'OLAF et au renforcement des droits procéduraux des personnes concernées par une enquête de l'OLAF; mesure l'importance de bien calibrer et d'évaluer soigneusement ces différents actes législatifs; demande au Conseil de prendre le temps nécessaire et de ne pas clore les négociations à la hâte, de manière à constituer un solide cadre juridique européen et à renforcer le volet institutionnel existant de la protection des intérêts financiers de l'Union; souligne qu'il convient de ne pas passer prématurément à la procédure de coopération renforcée; se félicite également du plan d'action destiné à renforcer la lutte contre la fraude et l'évasion fiscales, et la réforme du système de la TVA dans l'Union, toutes deux engagées en 2011;

It added a new instrument to the legal and political landscape, but more importantly it represented a strong and shared political commitment by all EU countries to strengthen their efforts to achieve real improvements.
