Settlement allows the offender to acknowledge his guilt, explicitly or implicitly, without having to go through legal proceedings, and to expiate it by carrying out obligations agreed between himself and Public Prosecutor, within the limits laid down by the legislation, which will in any case be less constraining than the normal criminal procedure to which he would be subject in the absence of an agreement. In return, the state drops proceedings.
La transaction permet ainsi à l'inculpé, sans devoir faire l'objet d'une procédure juridictionnelle, de reconnaître expressément ou implicitement sa faute et d'expier celle-ci par l'exécution des obligations dont le procureur et lui-même ont convenu, dans les limites établies par le législateur, lesquelles seront en tout état de cause moins contraignantes que la procédure pénale ordinaire dont il ferait l'objet à défaut d'accord. En contrepartie, le pouvoir public abandonne l'action publique, qui s'éteint.
