To attain this objective, the Commission recommends that the Member States should: 1. reinforce transparency in contractual relations, improve training and information in businesses and mitigate the fiscal effects of late payments (for example by deferring payment of VAT until the corresponding invoice has been settled) 2. ensure adequate recompense in cases of late payment by recognizing a right to interest at a sufficiently dissuasive rate for late payments; 3. guarantee appropriate redress procedures by encouraging low-cost extra-judicial procedures and by simplifying judicial procedures; 4. eliminate difficulties specific to cross-border trade; 5. improve payment periods for public procurement contracts, by adhering to a maximum period of 60 days.
Pour atteindre cet objectif, la Commission recommande aux Etats membres de : 1.renforcer la transparence dans les relations contractuelles, améliorer la formation et l'information des entreprises et atténuer les effets fiscaux de retards de paiement (par exemple en utilisant la possibilité de reporter le paiement de la TVA jusqu'à l'encaissement du prix); 2. assurer un dédommagement adéquat en cas de retard de paiement en reconnaissant un droit à des intérêts de retard suffisamment dissuasifs; 3. garantir des procédures de recours appropriées en encourageant les procédures extra- juridictionnelles peu coûteuses et en simplifiant les procédures juridictionnelles; 4. supprimer les difficultés spécifiques aux échanges transfrontaliers; 5. améliorer le paiement dans les marchés publics, en respectant un délai maximum de 60 jours.
