Calls on the EU to support efforts to resolve outstanding disputes, including border disputes, before accession; in line with the provisions of international law, the UN Charter and the relevant UN resolutions, as well as the Helsinki Final Act, encourages all parties to disputes whose continuation is likely to impair implementation of the acquis or endanger the preservation of international peace and security to engage constructively in their peaceful resolution and, if appropriate, in case of not being able to reach a bilateral agreement, to refer the matter to the International Court of Justice or to commit themselves to a binding arbitration mechanism of their choice or else work constructively within an intensive mediation mission; reiterates its call on the Commission and the Council to start developing, in accordance with the EU Treaties, an arbitration mechanism aimed at resolving bilateral and multilateral disputes;
27. demande à l'Union européenne de soutenir les efforts visant à résoudre les conflits en cours, en ce compris les conflits frontaliers, avant l'adhésion; encourage, conformément aux dispositions du droit international et des résolutions pertinentes des Nations unies, ainsi que de l'Acte final d'Helsinki, toutes les parties aux conflits, dont la poursuite est susceptible d’entraver la mise en œuvre de l’acquis ou de compromettre le maintien de la paix et de la sécurité internationales, à entamer leur résolution pacifique de manière constructive et à porter le cas échéant l’affaire, en cas d’impossibilité à conclure un accord bilatéral, devant la Cour internationale de justice ou à s’engager dans un mécanisme d’arbitrage contraignant de leur choix, ou à travailler de façon constructive dans le cadre d’une mission de médiation intensive; invite à nouveau la Commission et le Conseil à lancer le développement, conformément aux traités de l’UE, d’un mécanisme d’arbitrage visant à résoudre les litiges bilatéraux et multilatéraux;

Believes that not only mediation but ADR in general (Article 8 of Directive 2008/52/EC) should have an effect on limitation and prescription periods; acknowledges the risk posed by the many forms of ADR and the risk of abusive delay of court proceedings; notes that the feasibility study on European Contract Law provides for a suspension of prescription in the case of arbitration and mediation proceedings, and in certain other ADR situations; calls upon the Commission to continue work on this;

Congratulates the Commission on its initiative in establishing the European Extra Judicial Network (EEJ-NET) and the Financial Services complaints Network (FIN-NET), which support consumers seeking cross-border redress; calls upon the Commission, Member States and all interested parties to monitor the performance of EEJ-NET, FIN-NET and private-sector ADR schemes and the overlap between them; urges the Commission to consider means of ensuring that ADR systems available on- and off-line in the European Union have adequate resources and satisfy certain common high standards, in particular as regards the qualifications of persons who may act as mediators/arbitrators;
23. félicite la Commission d'avoir pris l'initiative d'instituer le Réseau européen extrajudiciaire (EEJ-NET) et le Réseau de règlement des plaintes concernant les services financiers (FIN-NET), destinés à aider les consommateurs dans leurs démarches pour obtenir réparation à l'échelle transfrontalière; prie la Commission, les États membres et toutes les parties concernées d'étudier d'une manière suivie le fonctionnement des réseaux EEJ-NET et FIN-NET ainsi que des systèmes alternatifs de résolution des litiges mis en place par le secteur privé, et les chevauchements entre les deux régimes;
