Migrants stranded in Libya will receive assistance and protection, including support to return decently to their home country if they wish to do so.

5. Expresses deep concern over the humanitarian crisis faced by thousands of people fleeing from the conflict areas, adding to the hardship already faced by over 1 million African refugees, asylum seekers and migrants stranded in Libya; encourages the Council, Commission and the HR/VP to assist UNHCR and other relevant agencies, such as IOM, WFP, ICRC, to order to provide protection and emergency assistance to all those in need;

9. Calls on all NTC forces to comply with international humanitarian laws in dealing with prisoners of war, namely the remaining pro-Gaddafi forces and mercenaries; urges the NTC to immediately free African migrant workers and black Libyans who were arbitrarily detained for being thought to be pro-Gaddafi mercenaries and bring to independent trial those who committed crimes; calls on the NTC to protect the rights of thousands sub-Saharan African migrants who face harassment solely due to their skin colour and to ensure protection and evacuation of the migrants still stranded at the IOM centres, such as in Sebha or any improvised camps;
9. invite l'ensemble des forces du Conseil national de transition à respecter le droit humanitaire international dans leur traitement des prisonniers de guerre, en l'occurrence les derniers soldats et mercenaires pro-Kadhafi; exhorte le Conseil national de transition à libérer immédiatement les travailleurs immigrés africains et les Libyens noirs qui, ayant été pris pour des mercenaires de M. Kadhafi, ont été emprisonnés arbitrairement, et à faire comparaître devant un tribunal indépendant ceux qui ont commis des crimes; invite le Conseil national de transition à protéger les droits des milliers d'immigrés d'Afrique subsaharienne victimes de harcèlements en raison de la seule couleur de leur peau et à assurer la protection et l'évacuation des immigrés encore retenus dans les centres de l'OIM, notamment à Sebha, ou dans des camps de fortune;

Furthermore, without corresponding agreements, either between countries of the region, or with countries of origin, there is a risk of creating a readmission trap in which third country nationals find themselves stranded in the region. This inevitably will create pressure for irregular migrants to make their way back to the EU.
Par ailleurs, en l'absence d'accords en la matière, soit entre les pays de la région, soit avec les pays d'origine, la réadmission risque de devenir un piège, les ressortissants des pays tiers se trouvant bloquer dans la région, ce qui incitera, inévitablement, les migrants irréguliers à regagner l'Union européenne.
