Definition: Voluntary, repetitive, stereotyped, nonfunctional (and often rhythmic) movements that do not form part of any recognized psychiatric or neurological condition. When such movements occur as symptoms of some other disorder, only the overall disorder should be recorded. The movements that are of a non self-injurious variety include: body-rocking, head-rocking, hair-plucking, hair-twisting, finger-flicking mannerisms, and hand-flapping. Stereotyped self-injurious behaviour includes repetitive head-banging, face-slapping, eye-poking, and biting of hands, lips or other body parts. All the stereotyped movement disorders occur most frequently in association with mental retardation (when this is the case, both should be recorded). If eye-poking occurs in a child with visual impairment, both should be coded: eye-poking under this category and the visual condition under the appropriate somatic disorder code. | Stereotype/habit disorder

In order to make a clear distinction between the rules that apply to non-commercial movement and to trade in and imports into the Union from third countries of dogs, cats and ferrets covered by the animal health requirements of Directive 92/65/EEC, this Regulation should not only define a pet animal, but also the non-commercial movement of a pet animal, during which such a pet animal accompanies its owner or an authorised person.
Afin de distinguer clairement les règles applicables aux mouvements non commerciaux de celles applicables aux échanges et à l’importation dans l’Union de chiens, de chats et de furets en provenance de pays tiers, lesquels sont soumis aux conditions de police sanitaire de la directive 92/65/CEE, il y a lieu que le présent règlement définisse non seulement ce que l’on entend par animal de compagnie, mais également ce que désigne un mouvement non commercial d’un animal de compagnie, au cours duquel celui-ci accompagne son propriétaire ou une personne autorisée.

5. In order to prevent commercial movement of pet animals of the species listed in Part B of Annex I from being fraudulently disguised as non-commercial movement, the Commission shall be empowered to adopt delegated acts in accordance with Article 39 laying down rules setting the maximum number of pet animals of those species that may accompany the owner or an authorised person during a single non-commercial movement.
5. In order to ensure uniform conditions for the implementation of this Regulation, implementing powers should be conferred on the Commission with respect to the list of Member States or parts thereof that have equivalent favourable status with regard to rabies and that are authorised to conclude mutual agreements to derogate from certain conditions applicable to the non-commercial movement of pet animals, the list of Member States categorised in accordance with the rules concerning preventive health measures against diseases and infections other than rabies, the lists of territories and third countries established for the purpose of derogating from certain conditions applicable to non-commercial movement, the model for the identification documents that are to accompany pet animals of the species listed in Annex I during non-commercial movement into a Member State from another Member State or from a territory or a third country, the rules on the format, layout and languages of the declarations to be signed, and the safeguard measures in the event of the occurrence or spread of rabies or of a disease or infection other than rabies.

Since the objective of this Regulation, namely to lay down animal health requirements for the non-commercial movement of pet animals of the species listed in Annex I in order to prevent or minimise risks to public or animal health arising from such movement, cannot be sufficiently achieved by the Member States and can therefore be better achieved at Union level, the Union may adopt measures, in accordance with the principle of subsidiarity set out in Article 5 of the Treaty on European Union.

(134) In order to ensure movement control for aquatic animals, the power to adopt acts in accordance with Article 290 of the Treaty on the Functioning of the European Union should be delegated to the Commission, concerning the disease preventive measures applicable to transport, specific rules for movements of certain categories of aquatic animals for different purposes, specific requirements or derogations for certain types of movements, such as movement for scientific purposes and additional requirements for movement of wild aquatic animals.
(134) Afin de garantir l’exercice d’un contrôle des mouvements d’animaux aquatiques, il convient de conférer à la Commission le pouvoir d’adopter des actes conformément à l’article 290 du traité sur le fonctionnement de l’Union européenne en ce qui concerne les mesures de prévention des maladies applicables aux transports, les dispositions spécifiques relatives aux mouvements de certaines catégories d’animaux aquatiques à différentes fins, les exigences ou dérogations spécifiques pour certains types de mouvements, tels que les mouvements à des fins scientifiques, ainsi que les exigences supplémentaires concernant les mouvements d’animaux aquatiques sauvages.

(138) In order to ensure the possibility of laying down movement rules for those animals that are not defined as terrestrial and aquatic animals by this Regulation, and germinal products and products of animal origin from them, when a risk so warrants, the power to adopt acts in accordance with Article 290 of the Treaty on the Functioning of the European Union should be delegated to the Commission, concerning the registration and approval of establishments, record keeping and registers, identification and registration and traceability movement requirements, animal health certification and self-declaration and movement notification obligations for animals, germinal products and products of animal origin of those species.
(138) Afin de garantir la possibilité, lorsqu’un risque le justifie, de fixer des dispositions relatives aux mouvements des animaux qui ne correspondent à la définition des animaux terrestres ou aquatiques dans le présent règlement, ainsi qu’aux produits germinaux et aux produits d’origine animale qui en sont issus, il convient de conférer à la Commission le pouvoir d’adopter des actes conformément à l’article 290 du traité sur le fonctionnement de l’Union européenne en ce qui concerne l’enregistrement et l’agrément des établissements, la tenue de dossiers et les registres, les exigences relatives à l’identification, l’enregistrement et la traçabilité des mouvements, ainsi que les obligations en matière de certification zoosanitaire, d’autodéclaration et de notification des mouvements pour les animaux, les produits germinaux et les produits d’origine animale issus de ces espèces.

It is appropriate, in accordance with Directive 92/65/EEC, to lay down, by way of derogation from the general rules on animal movements in Chapter II of that Directive, special animal health requirements for the movement of circus animals.
Il convient, conformément à la directive 92/65/CEE, de définir des conditions de police sanitaire spécifiques applicables aux mouvements des animaux de cirque, par dérogation aux règles générales sur les mouvements d'animaux prévues au chapitre II de la directive précitée.
