IN-CONTEXT TRANSLATIONS

Where a Member State, taking into account its application pursuant to Article 10c(5) of Directive 2003/87/EC and the relevant Commission Decision pursuant to Article 10c(6) of that Directive, issues the allowances to be granted free of charge on the basis of Article 10c of Directive 2003/87/EC irrespective of investments already undertaken (ex-ante issuance of allowances), the Member State should include in the national allocation table the allocation to be granted free of charge in accordance with Article 10c of Directive 2003/87/EC for the period 2013 to 2019, when notifying the national allocation table to the Commission pursuant to Article 51(1) of this Regulation.

Nothing in this Regulation should prevent a competent authority from requiring an operator to transfer a number of allowances, received in excess of its adjusted allocation for the relevant year, to the EU Allocation Account in cases where there has been an over allocation of allowances, including as a result of an error in the original allocation or the operator having failed to correctly or completely submit to the competent authority information pursuant to Article 24 of Decision 2011/278/EU by the date set out in that Article, provided that the central administrator has made a change to the national allocation table of the Member State pursuant to Article 52(2) of this Regulation to adjust the allocation accordingly.

Regulation (EU) 1193/2011 provided deadlines for the terms of cooperation between the central administrator and national administrators to be agreed and for the notification of national allocation tables and national aviation allocation tables.

2. The Commission shall instruct the central administrator to enter the national allocation table into the EUTL if it considers that the national allocation table is in conformity with Directive 2003/87/EC, Decision 2011/278/EU and decisions adopted by the Commission pursuant to Article 10c(6) of Directive 2003/87/EC.

On receiving a notification pursuant to the first subparagraph, the Commission shall instruct the central administrator to make the corresponding changes to the national allocation table held in the EUTL. if it considers that the changes to the national allocation table are in conformity with Directive 2003/87/EC, Decision 2011/278/EU and decisions adopted by the Commission in accordance with Article 10c(6) of Directive 2003/87/EC.

Believes that this logic also prevailed in the way the MFF agreement was struck by the European Council on 8 February 2013; considers it regrettable that this was reflected in the fact that the national allocations, especially from the two biggest areas of expenditure in the EU budget, agriculture and cohesion policy, were determined at that moment; criticises, in particular, the increased number of special allocations and ‘gifts’ granted in the course of negotiations between Heads of State and Government, which are not based on objective and verifiable criteria, but rather reflect the bargaining power of Member States, trying to secure their national interests and maximise their net returns; denounces the lack of transparency in striking this agreement and the reluctance of the Council and the Commission to provide Parliament with all relevant documents; highlights that the European added value should prevail over national interests;

The Commission shall, for the duration of the first multiannual work programme, ensure geographical balance for projects other than integrated projects submitted under the sub-programme for Environment, by proportionately distributing funds among all Member States according to indicative national allocations established in accordance with the criteria set out in Annex I. Where indicative national allocations are not applicable, projects shall be selected exclusively on the basis of merit.
5. Your rapporteur considers that the necessary budgetary changes to the European Refugee Fund will provide adequate funding for the new agency in its initial phases drawing funding from the part of the Fund allocated for cooperation between Member States, thus substituting this more ad-hoc cooperation for a stable institution specifically designed to meet the need for ongoing support. The reallocation of funding does not affect national allocations.
Votre rapporteure estime que les modifications budgétaires qui devront être apportées au Fond européen pour les réfugiés permettront de financer la nouvelle agence dans ses phases initiales sur la partie du fond allouée à la coopération entre les États membres, remplaçant ainsi cette coopération plus ponctuelle par une institution stable spécialement conçue pour répondre à un besoin d'assistance permanent. La réaffectation des financements n'a aucune répercussion sur les allocations nationales.

6. Stresses that whilst the Kyoto Protocol's enforcement mechanism - whereby, when a country exceeds its allowed emissions in the first commitment period, it will be required to make up the difference during the second commitment period - is good in theory, it is yet to be tested; calls on the Commission and the Members States to rigorously apply the Kyoto Protocol's enforcement mechanism and to contribute to an ambitious and inclusive post-2012 framework, engaging through equitable, differentiated and fair targets; stresses the urgent need for States which did not participate during the first period to join in the second commitment period, and to examine the possible nature of their participation according to their national circumstances; considers that, in the in the second commitment period, emissions should be allocated on a sectoral basis, through internationally agreed benchmarks and eventually combined with other national allocation targets, reflecting the principles of allocation per capita;
6. souligne que, si le mécanisme de mise en œuvre du protocole de Kyoto, selon lequel un pays qui dépasse son quota d'émissions autorisé au cours de la première période d'engagement devra compenser ce dépassement au cours de la deuxième période est valable en théorie, il doit encore être testé; invite la Commission et les États membres à appliquer rigoureusement le mécanisme de mise en œuvre du protocole de Kyoto et à contribuer à créer un cadre ambitieux et global pour la période postérieure à 2012, grâce à des objectifs équitables, différenciés et justes; souligne qu'il est impératif que les États qui n'ont pas participé à la première période d'engagement s'associent à la deuxième et que l'on examine la possibilité de leur participation en fonction des circonstances nationales; estime qu'il conviendrait, dans la deuxième période d'engagement, de répartir les droits sur une base sectorielle, au moyen de critères établis à l'échelle internationale et avec la participation de tous les secteurs impliqués dans le commerce international, et de les combiner à terme à d'autres objectifs de répartition nationaux reflétant les principes de la répartition par habitant;
