These three objectives have been widely agreed as having a real European added value by cultural stakeholders (see the EP resolutions of 22 October 2002 and of 4 October 2003 respectively on the importance and dynamism of theatre and the performing arts in an enlarged Europe and on cultural industries, as well as the Council Resolution of 19 December 2002 on European added value and mobility of persons and circulation of works in the cultural sector, the conclusions of the Forum on cultural cooperation of November 2001 and the results of the public consultation on a new programme).

Largely inspired by the Treaty provisions on economic policy co-ordination [2] and by the co-ordination of employment policies launched at the Essen European Council of 1994, the new Art. 128 instituted a framework for developing national employment policies on the basis of shared European priorities and interests.

The European institutions have themselves spoken out on many occasions on subjects relating to Community cultural action and the challenges of cultural cooperation, in particular in Council Resolutions of 25 June 2002 on a new work plan on European cooperation in the field of culture and of 19 December 2002 implementing the work plan for European cooperation in the field of culture , resolutions of the European Parliament of 5 September 2001 on cultural cooperation in the European Union , of 28 February 2002 on the implementation of the Culture 2000 Programme , of 22 October 2002 on the importance and dynamism of the theatre and the performing arts in an enlarged Europe , and of 4 September 2003 on Cultural Industries , and the opinion of the Committee of the Regions of 9 October 2003 on the extension of the Culture 2000 Programme.

The Council’s proposed definition is to be found in Article 2(b): ‘”Technical contributions” means a contribution to the state of the art in the field of technology which is new and not obvious to a person skilled in the art. The technical contribution shall be assessed by consideration of the difference between the state of the art and the scope of the patent claim considered as a whole, which must comprise technical features, irrespective of whether or not these are accompanied by non-technical features’.
