that entity is a parent undertaking of an entity in the financial sector, an entity which holds a participation in an entity in the financial sector, or an entity linked with an entity in the financial sector by a relationship within the meaning of Article 12(1) of Directive 83/349/EEC.

2. The Member States shall require regulated entities or mixed financial holding companies to report on a regular basis and at least annually to the coordinator any significant risk concentration at the level of the financial conglomerate, in accordance with the rules laid down in this Article and in Annex II. The necessary information shall be submitted to the coordinator by the regulated entity within the meaning of Article 1 which is at the head of the financial conglomerate or, where the financial conglomerate is not headed by a regulated entity within the meaning of Article 1, by the mixed financial holding company or by the regulated entity in the financial conglomerate identified by the coordinator after consultation with the other relevant competent authorities and with the financial conglomerate.
2. Where the financial establishment and the entity referred to in this paragraph are established in different Member States, the financial establishment paying the interest is obliged to communicate information to its competent authority concerning the name and address of the entity to which the interest is paid and the overall amount paid to that entity; such information is then communicated to the competent authority of the State of the entity.

However, certain additional provisions were considered appropriate to reinforce supervisors' ability to monitor the entities coming within their supervisory remit, i.e.: (1) the addition to the list of authorization conditions of a further condition under which any group of which the credit institution, insurance undertaking or investment firm is a member must be transparent i.e. must be such as to permit effective supervision of the entity on an individual basis; (2) an additional requirement whereby credit institutions and insurance undertakings must maintain their head offices in the same Member States as the registered office as otherwise effective supervision by the home Member State competent authorities would be made more difficult (this has already been laid down for investment firms); (3) a widening of the list of bodies with whom confidential supervisory information can be exchanged by the competent authorities; (4) the imposition on auditors of an obligation to report to the competent authority where in the carrying out of their function asstatutory auditors of the financial undertaking concerned irregular circumstances become known to them which might be detrimental either to the customers of the institution, to the financial system or to the soundness of the financial undertaking itself.
