Member States shall provide that professionals, in respect of whom alerts are sent to other Member States, are informed in writing of decisions on alerts at the same time as the alert itself, may appeal under national law against the decision or apply for rectification of such decisions and shall have access to remedies in respect of any damage caused by false alerts sent to other Member States, and in such cases the decision on the alert shall be qualified to indicate that it is subject to proceedings by the professional.
6. Once the system is operational and alerts are included in it, the SIS II will only be possible to store the following information on persons for whom an alert has been issued: surname(s) and forename(s), name(s) at birth, aliases, specific physical characteristics, place and date of birth, sex, photographs, fingerprints, nationality(ies), whether the person concerned is armed, violent or has escaped, reason for the alert, authority issuing the alert, a reference to the decision giving rise to the alert and link(s) to other alerts issued in SIS II. It will also include the action to be taken in the event that there is a “hit” (i.e. if a competent national authority finds an alert in SIS II concerning a non-EU national on whom they have carried out a check).

Given the priority of SIS II alerts over Interpol alerts, the use of Interpol alerts shall be restricted to exceptional cases (i.e. where there is no provision, either in the Convention or in technical terms, to enter the alert in the SIS II, or where not all the necessary information is available to form a SIS II alert).

Alerts on persons for discreet or specific checks are not compatible with alerts for arrest, alerts for refusal of entry, alerts on missing persons or alerts for a judicial procedure.

(12) The SIS II should contain alerts on missing persons to ensure their protection or prevent threats, alerts on persons wanted for judicial procedure, alerts on persons and objects for discreet checks or specific checks and alerts on objects for seizure or use as evidence in criminal proceedings.
