France contended that the directive contains no provision establishing an absolute principle of freedom to set rates which would extend to the manner in which the cost of insurance is calculated, and that nothing therefore precludes the inclusion in the method of calculating insurance premiums of a mandatory coefficient which has no effect on the initial level of the premiums and affects their alteration in a very small part only, since there is still overall freedom to set the final price.
La France soutient quant à elle que la directive ne contient aucune disposition posant un principe absolu de liberté tarifaire qui s’étendrait aux modalités de calcul du prix des assurances et que donc rien n’interdit d’inclure dans la méthode de calcul des primes d’assurance un coefficient obligatoire, sans effet sur le niveau initial de celles-ci et qui n’affecte que très partiellement leur évolution, dès lors que la fixation du prix final reste globalement libre.

3. Nothing in this Agreement shall preclude the use of information or documents obtained in accordance with this Agreement as evidence in administrative proceedings subsequently instituted in respect of operations in breach of customs legislation. Therefore, the Contracting Parties may, in their records of evidence, reports and testimonies and in administrative proceedings use as evidence information obtained and documents consulted in accordance with the provisions of this Agreement.
3. Aucune disposition du présent accord ne fait obstacle à l’utilisation, en tant que preuves, de renseignements et de documents obtenus conformément aux dispositions du présent accord dans le cadre d’actions administratives engagées à la suite de la constatation d’opérations contraires à la législation douanière. Dès lors, les parties contractantes peuvent faire état, à titre de preuves, dans leurs procès-verbaux, de rapports et de témoignages, ainsi qu’au cours de procédures administratives de renseignements recueillis et de documents consultés conformément aux dispositions du présent accord.
