(2) Notwithstanding anything in this section, where a person who applies for a special renewal permit pursuant to paragraph (1)(b) and the Minister have not agreed on the terms and conditions for the special renewal permit within 30 days after the expiry of the period within which Petro-Canada Limited is required to give the notice specified in subsection 121(6) or within 30 days after Petro-Canada Limited gives any such notice, whichever occurs first, that person shall for 30 days thereafter have the right to reinstate his application for an oil and gas lease under section 54 as if it had not been withdrawn and he were still a permittee, whereupon he shall be entitled to be repaid any sums he paid as rental except that sum tendered with the lease application in respect of the first year thereof, and that sum shall be deemed to satisfy all rental obligations under that lease up to the first anniversary date thereof following August 3, 1977.
(2) Par dérogation au présent article, lorsque la personne demandant un permis avec clause spéciale de renouvellement conformément à l’alinéa (1)b) et le ministre n’ont pu s’entendre sur les modalités de ce permis dans un délai de 30 jours après l’expiration de la période durant laquelle Petro-Canada Limitée doit donner l’avis précisé au paragraphe 121(6) ou dans un délai de 30 jours après que Petro-Canada Limitée ait donné cet avis, la plus ancienne date étant retenue, cette personne pourra, pendant les 30 jours qui suivent, rétablir sa demande de concession de pétrole et de gaz en vertu de l’article 54 comme si cette dernière n’avait pas été retirée et que cette personne était toujours titulaire, sur quoi elle est fondée de se faire rembourser tout montant payé à titre de location, sauf le montant versé avec la demande de concession pour la première année, et ce montant est considéré comme couvrant toutes les dépenses de location en vertu de la concession jusqu’à la date du premier anniversaire suivant le 3 août 1977.

(2) At the time set out in a lease for setting the rental rate, the lessee may, by written notice to the Minister, choose a rental rate set out in section 7, 8, 11, 13 or 14 that is applicable to the location, use and conditions of occupancy of the leased public lands and the purpose for which the lease was granted, and the lease shall be amended to include that rental rate as a term of the lease.

(2) Every conditional lease or licence is deemed to include provisions to the effect that, when the leased lands are required in connection with a water-power development and upon giving the conditional lessee or licensee not less than six months’ notice of cancellation in writing under his hand, the Minister may cancel the lease or licence, and terminate the rights thereby conferred, and repossess himself on behalf of Her Majesty of the leased lands and all improvements thereon without any compensation whatever being paid to the conditional licensee or lessee.
