TRADUCTIONS EN CONTEXTE

In order to ensure uniform conditions for the implementation of this Regulation, implementing powers should be conferred on the Commission in respect of setting out the annual breakdown, by Member State, of the global resources available for commitments in the framework of shared management approving the operational programmes and their amendments, approving the work plans for data collection, adopting the annual work programmes relating to technical assistance at the initiative of the Commission, recognising that there is evidence suggesting non-compliance with obligations under the CFP, recognising that a Member State has failed to comply with its obligations under the CFP, suspending all or part of the interim payments under the operational programme and making financial corrections by cancelling all or part of the Union support for an operational programme.
Afin d’assurer des conditions uniformes d’exécution du présent règlement, il convient de conférer des compétences d’exécution à la Commission en ce qui concerne la répartition annuelle, par État membre, des ressources globales disponibles pour les engagements pris dans le cadre de la gestion partagée, l’approbation des programmes opérationnels et leurs modifications, l’approbation des programmes nationaux relatifs à la collecte des données, l’adoption des programmes de travail annuels relatifs à l’assistance technique à l’initiative de la Commission, la reconnaissance de l’existence de preuves indiquant un manquement grave aux obligations découlant de la PCP, la reconnaissance de ce qu’un État membre n’a pas respecté les obligations qui lui incombent au titre de la PCP, la suspension de tout ou partie des paiements intermédiaires effectués au titre du programme opérationnel, et la réalisation des corrections financières en annulant tout ou partie du soutien apporté par l’Union à un programme opérationnel.

Stresses, moreover, that in order to have the Operational Programmes adopted, a corresponding draft amending budget covering the respective commitment appropriations for 2015 also needs to be approved, and that this implies, in the best-case scenario, a delay in the effective start of the implementation of those programmes until mid-2015;

Is aware that the re-budgeting of uncommitted amounts from 2014 in 2015 under Article 19 of the MFF implies a revision of the MFF by 1 May 2015 which, albeit technical, has to comply with the multiannual budget procedure: a proposal for a revision of the MFF by the Commission, consent by Parliament and adoption by unanimity by the Council; stresses, moreover, that in order to have the Operational Programmes adopted, a corresponding draft amending budget covering the respective commitment appropriations for 2015 also needs to be approved, which implies, in the best-case scenario, a delay in the effective start of implementation of those programmes until mid-2015;

A pre-financing payment at the start of the operational programme should ensure that the Member State has the means to provide support to the beneficiaries in the implementation of the operations starting from the adoption of the operational programme.
La possibilité d'obtenir un préfinancement dès le début du programme opérationnel devrait permettre de garantir que l'État membre dispose des moyens nécessaires, dès l'adoption du programme opérationnel, pour aider les bénéficiaires dans l'exécution des opérations.

2. The joint operational programme adopted by the Commission shall be a technical annex to the financing agreement.
2. Le programme opérationnel conjoint adopté par la Commission constitue l’annexe technique de la convention de financement.

To that end, this Commission Decision will also constitute the financing decision for the operational programmes of Belgium, Ireland, Malta, Poland, Slovenia, Hungary and United Kingdom that have not been adopted in 2007 and therefore allowing for the first budget commitment in respect of the above operational programmes before the adoption of the Decision of the Commission approving the above operational programmes.
À cette fin, la présente décision de la Commission constituera aussi la décision de financement pour les programmes opérationnels de la Belgique, de l'Irlande, de Malte, de la Pologne, de la Slovénie, de la Hongrie et du Royaume-Uni qui n'ont pas été adoptés en 2007 et permettra donc le premier engagement budgétaire pour les programmes opérationnels susmentionnés avant l'adoption de la décision de la Commission approuvant lesdits programmes.

6. In order to allow the joint operational programmes to prepare adequately for implementation, after the adoption of the joint operational programme and before the signature of the financing agreement, the Commission may allow the joint managing authority to use part of the programme budget to start financing programme activities such as the incurring of operational costs of the managing authority, technical assistance and other preparatory actions.

Pour permettre une préparation adéquate de la mise en œuvre des programmes opérationnels conjoints, après l'adoption du programme opérationnel conjoint et avant la signature de la convention de financement, la Commission peut autoriser l'autorité de gestion commune à utiliser une partie du budget du programme pour commencer à financer les activités du programme, comme les coûts opérationnels de l'autorité de gestion, l'assistance technique et d'autres actions préparatoires.
