to ensure that nothing will prevent the EU and its Member States from maintaining, improving and applying labour and social regulations, collective agreements and legislation on the entry of natural persons into, or temporary stay in, the EU’s or a Member State’s territory, including those measures necessary to ensure the orderly movements of natural persons across its borders such as, inter alia, admission or conditions for admission for entry; to guarantee, in line with Directive 96/71/EC on the posting of workers, that the minimum terms and conditions of employment of the host country are applicable to any service suppliers accessing the EU, today and in the future; to ensure that all workers coming into Europe, irrespective of their home country, enjoy the same labour rights as nationals in their host country and that the principle of equal pay for equal work is respected; to ensure that the eight fundamental International Labour Organisation (ILO) Conventions are ratified and effectively implemented by TiSA parties; to call on all parties to ratify and implement the principal ILO standards and to promote other relevant ILO Conventions and UN resolutions; to ensure that the EU’s and Member States’ labour laws and collective agreements are respected within the EU’s territory; to strengthen the EU monitoring and enforcement mechanism in order to deter infringements; to urge Member States to increase the resources available to labour inspectorates; to urgently collate and present detailed information on the number and type of service providers currently operating in the EU under Mode 4, including the duration of their stay; to ensure much more efficient cross-border access to data within the EU in the future; to include a safety clause preventing companies from circumventing or undermining the right to take industrial action through the use of workers from third countries during negotiations on collective agreements and labour disputes, and to allow TiSA ...

· The revised GPA includes new provisions for developing countries wishing to join the GPA. Developing countries that have started their accession process to the Agreement may benefit from a set of transitional measures: They include: i) price preferences; (ii) offsets; (iii) phased-in addition of specific entities and sectors; and (iv) thresholds that are initially set higher than their permanent level. Provision has also been introduced for delaying the application of any specific obligation contained in the GPA, other than the requirement to provide equivalent treatment to the goods, services and suppliers of all other Parties to the Agreement, for a period of five years following accession to the Agreement for Least Developed Countries (LDCs) or up to three years for other developing countries. This period can be further extended;

We know that the negotiations on these and on other agreements are of the highest quality, but it is important for us to be aware of the strengths and weak points of the agreements after they come into force, so that we can make a better contribution. This will make it easier to guarantee Parliament’s support for the agreements.

4. Without prejudice to any other provisions of this Agreement, either Management Entity may run labelling programs with respect to product types not included in Annex C. Notwithstanding any other provisions of this Agreement, neither Party shall hinder the import, export, sale or distribution of any product because it bears the energy-efficiency marks of the Management Entity of the other Party.

He has called upon the Commission to provide a comprehensive annual report on the implementation of the Agreement - together with the Protocol and the Annexes, which form an integral part thereof - in order to enable Parliament to assess more effectively and with greater transparency whether or not the various objectives stated in the Agreement have been achieved, whether or not the Agreement is fully operational, whether or not it acts in the interests of the parties involved and whether or not it is cost-effective for the Community and its fisheries sector. This will afford the sector greater legal security, including monitoring of the application of the exclusivity clause laid down in the Agreement (Article 6) in order to ensure that other parties are not offered (by means of private agreements) opportunities to fish for high-commercial-value species which are withheld from the Community under the public Agreement on the pretext that resources have to be conserved.

In accordance with Council Regulation (EC, Euratom) No 1605/2002 of 25 June 2002 and the financial regulation adopted by the Management Board of the Agency on 26 March 2003, with Commission Regulation (EC, Euratom) No 2343/2002 of 23 December 2002 and with the other instruments referred to in this Agreement, contracts or agreements concluded and decisions taken with beneficiaries established in Switzerland may provide for scientific, financial, technological or other audits to be conducted at any time on the premises of the beneficiaries and of their subcontractors by Agency and Commission officials or by other persons mandated by the Agency and the Commission.

In the framework of the Agreement, the funds earmarked under the multi-annual financial framework of cooperation under this Agreement, own resources of the European Investment Bank (hereinafter referred to as the Bank) and where appropriate other resources drawn from the European Community’s budget, shall be used to finance projects, programmes and other forms of operations contributing to the achievement of the objectives of this Agreement’.

Thirdly, the new directives need to be based both upon international conventions – I am thinking of those concerning ethnic minorities and indigenous peoples, as important in Mercosur as in other countries – and upon agreements connected with the International Labour Organisation. In that way, monitoring mechanisms might be established, designed to improve the specific ways in which unions operate and workers are organised and providing not only for joint participation in the UN and other international bodies – something which would lend more importance to this agreement – but also for the existence of explicit mechanisms for dialogue in matters relating to the common European security and defence policy, as recommended recently by the Institute for European-Latin American Relations.
