In a multilingual European Union, this means that: i) everybody should have the opportunity to communicate appropriately in order to realise his or her potential and make the most of the opportunities offered by the modern and innovative EU; ii) everybody should have access to appropriate language training or to other means of facilitating communication so that there is no undue linguistic obstacle to living, working or communicating in the EU; iii) in the spirit of solidarity, even those who may not be able to learn other languages should be provided with appropriate means of communication, allowing them access to the multilingual environment.

The ban on money-lending is an extreme example but there are other, more contemporary cases of countries having different social arrangements for the organisation of the labour market. This is true of Europe and the US: as the OECD has shown, they have differently organised labour markets (emphasis on providing people with security in Europe, greater flexibility in the US), giving rise to different forms of innovation (incremental and cumulative in Europe, more abrupt in the US) which in the end prove to be complementary, even in sectoral terms (technology sector geared to aircraft engineering and vehicle manufacture in Europe, precision instruments and software in the US). The even more flagrant differences between developing and industrialised countries are another one of the fundamental divisions of international labour.

[77] Motifs de refus: a) si l'exécution est contraire aux principes fondamentaux de l'ordre juridique de l'État requis; b) si l'État requis estime que l'infraction réprimée par la condamnation revêt un caractère politique ou qu'il s'agit d'une infraction purement militaire; c) si l'État requis estime qu'il y a des raisons sérieuses de croire que la condamnation a été provoquée ou aggravée par des considérations de race, de religion, de nationalité ou d'opinion politique; d) si l'exécution est contraire aux engagements internationaux de l'État requis; e) si le fait est l'objet de poursuites dans l'État requis ou si celui-ci décide d'entamer des poursuites; f) si les autorités compétentes de l'État requis ont décidé de ne pas engager de poursuites ou de mettre fin aux poursuites qu'elles ont exercées pour le même fait; g) si le fait a été commis hors du territoire de l'État requérant; h) si l'État requis n'est pas à même d'exécuter la sanction; i) si la demande est fondée sur l'alinéa e) de l'article 5 (« s'il estime qu'il n'est pas en mesure d'exécuter lui-même la sanction, même en ayant recours à l'extradition, et que l'autre Etat l'est »), et qu'aucune des autres conditions prévues par cet article n'est remplie; j) si l'État requis estime que l'État requérant est à même d'exécuter lui-même la sanction; k) si, en raison de son âge au moment de la commission du fait, le condamné ne pouvait pas être poursuivi dans l'État requis; l) si la sanction est déjà prescrite selon la loi de l'État requis; m) dans la mesure où le jugement prononce une déchéance.

According to the Convention, the sentencing State may request another Contracting State to enforce a sentence only if one or more of the conditions set out in Article 5 are fulfilled, namely: (a) if the sentenced person is ordinarily resident in the other State; (b) if the enforcement of the sentence in the other State is likely to improve the prospects for the social rehabilitation of the sentenced person; (c) if, in the case of a sentence involving deprivation of liberty, the sentence could be enforced following the enforcement of another sentence involving deprivation of liberty which the sentenced person is undergoing or is to undergo in the other State; (d) if the other State is the State of origin of the sentenced person and has declared itself willing to accept responsibility for the enforcement of that sentence; or (e) if it considers that it cannot itself enforce the sentence, even by having recourse to extradition, and that the other State can. In addition, the judgment handed down in the requesting State must be final and enforceable and the offence in respect of which the sentence has been passed must also constitute an offence under the law of the requested State ("double criminality" requirement [76]).

En outre, la décision prononcée dans l'État requérant doit être définitive et exécutoire et l'infraction en raison de laquelle la sanction a été prononcée doit constituer également une infraction selon la législation de l'État requis (exigence de « double incrimination » [76]).

Full mutual recognition as envisaged to be achieved among EU Member States would have to be based on the principle that a decision taken by no matter which authority in the EU fully deals with the issue and that no further decision needs to be taken at all, i.e. the principle of exhaustion. In other words, if someone was convicted or acquitted [14] for a criminal offence committed in Member State A, he should not be prosecuted for the same facts, however they may be qualified, in Member State B, even if Member State B has jurisdiction over the facts (because e.g. the person in question is a national of Member State B) and even if in Member State B, a different judgement could have been pronounced (e.g. because the offence in question can be punished by longer deprivation of liberty).

An employee of a legal person to which this paragraph applies may also represent other legal persons which have economic connections with the first legal person, even if those other legal persons have neither their domicile nor their principal place of business nor a real and effective industrial or commercial establishment within the Community.
