Reduction of participation rights means a proportion of members of the organs of the SPE within the meaning of Article 2(k) of Directive 2003/72/EC, which is lower than the highest proportion existing within the participating companies.

(a) a special negotiating body representing the employees of the participating companies and concerned subsidiaries or branches shall be created in accordance with the following provisions:

- if, before registration of the SE, one or more forms of participation applied in one or more of the participating companies covering at least 50 % of the total number of employees in all the participating companies; or

3. In order for an SE to be registered in a Member State which has made use of the option referred to in Article 7(3) of Directive 2001/86/EC, either an agreement pursuant to Article 4 of the Directive must have been concluded on the arrangements for employee involvement, including participation, or none of the participating companies must have been governed by participation rules prior to the registration of the SE.
3. Pour qu'une SE puisse être immatriculée dans un État membre ayant fait usage de la faculté visée à l'article 7, paragraphe 3, de la directive 2001/86/CE, il faut qu'un accord, au sens de l'article 4 de ladite directive, sur les modalités relatives à l'implication des travailleurs, y compris la participation, ait été conclu, ou qu'aucune des sociétés participantes n'ait été régie par des règles de participation avant l'immatriculation de la SE.

These requirements have also been strengthened by Parliament’s amendments, of which the following stand out: the obligation to comply with environmental legislation by participating companies, establishing more demanding standards for the qualification and training of the environmental verifiers who accredit the companies, public reports on the environmental performance of companies, with absolute credibility for third parties, greater involvement of the interested parties in the process of monitoring the environmental performance of companies and, in particular, of employees and users, extension of environmental responsibility, which goes beyond the company’s facilities, to include indicators of the performance of products and services, in line with the approach of the new environmental directives, and also an increase in the role of the coordinating bodies with the aim of facilitating the homogenous application of the system in the various Member States.
De même, ces conditions requises ont été renforcées par les amendements du Parlement, parmi lesquels on peut distinguer : l'obligation, pour les entreprises qui ont adhéré au système, de respecter la législation environnementale ; l'établissement de normes plus strictes en ce qui concerne les qualifications et la formation des vérificateurs environnementaux qui accréditent les entreprises ; l'élaboration de rapports publics relatifs au comportement des entreprises à l'égard de l'environnement et dotés d'une crédibilité absolue face à des tiers ; une plus grande implication des parties intéressées à la procédure de contrôle et de suivi du comportement des entreprises à l'égard de l'environnement, tout particulièrement des travailleurs et de leurs représentants ; un élargissement de la responsabilité environnementale, dépassant le cadre des installations de l'entreprise et incluant des indicateurs de comportement relatifs aux produits et aux services, conformément à l'approche des nouvelles directives environnementales ; et, pour terminer, un renforcement du rôle des organes de coordination dans le but de pouvoir appliquer le système de manière homogène dans les différents États membres.
