Decision 15/CP.17 of the Conference of the Parties to the United Nations Framework Convention on Climate Change (UNFCCC), in order to implement the use of the 2006 IPCC Guidelines for National Greenhouse Gas Inventories of the Intergovernmental Panel on Climate Change, determines that from 2015 until a further decision by the Conference of the Parties to the UNFCCC the GWP used by the Parties to calculate the carbon dioxide equivalence of anthropogenic emissions by sources and removals by sinks of greenhouse gases should be those listed in Annex III to Decision 15/CP.17.

Recalls its serious concerns over the tension in the South China Sea; considers it regrettable that, contrary to the 2002 Declaration of Conduct, several parties are claiming land in the disputed waters; is particularly concerned at the massive scale of China’s current activities in the area, including building military facilities, ports, and at least one airstrip; urges all parties in the disputed area to refrain from unilateral and provocative actions and to resolve the disputes peacefully based on international law, in particular the UNCLOS, with impartial international mediation and arbitration; urges all parties to acknowledge the jurisdiction of both UNCLOS and the Court of Arbitration, and calls for respect for any eventual decision by UNCLOS; supports all steps that will enable the South China Sea to become a ‘sea of peace and cooperation’; also supports all endeavours to ensure that the parties agree on a code of conduct for the peaceful exploitation of the maritime areas in question, including the establishment of safe trade routes, and encourages confidence-building measures; believes that the EU should engage in bilateral and multilateral cooperation in order to effectively contribute to security in the region.

This means that the agreement must reduce the parties’ decision-making independence (30), either due to obligations contained in the agreement which regulate the market conduct of at least one of the parties or by influencing the market conduct of at least one of the parties by causing a change in its incentives.

7. If the tribunal determines that there has been a violation of this Agreement and the responsible Party does not cure the violation, or does not reach agreement with the other Party on a mutually satisfactory resolution within 40 days after notification of the tribunal's decision, the other Party may suspend the application of comparable benefits arising under this Agreement until such time as the Parties have reached agreement on a resolution of the dispute.
7. Si le tribunal estime qu'il y a eu violation du présent accord et que la partie responsable de cette violation n'y remédie pas ou ne parvient pas, dans les quarante jours suivant la notification de la décision du tribunal, à un accord mutuellement acceptable avec l'autre partie, cette dernière peut suspendre l'application d'avantages comparables découlant du présent accord, jusqu'à ce que les parties parviennent à régler le différend.

Reference may in particular be made, in that connection, to the obligation imposed on the parties to the Convention to establish the import regime applicable to the products that are subject to that procedure (Article 10(1) to (5)), the disclosure of the essential elements of that regime to any natural or legal person with an interest (Article 10(8)) or the obligation imposed on exporting parties to ensure compliance by exporters within their jurisdiction with the regimes laid down by the importing parties and, in particular, to prohibit, subject to clearly circumscribed exceptions, any export of the products listed in Annex III to the Convention to a party to the Convention which has not notified to the secretariat the import regime applicable to those products or has merely notified to it an interim response not containing a decision concerning the interim import regime (Article 11(1)(b) and (2)).

(2) Whereas this dispensation relates in particular to agreements, decisions and concerted practices where the only parties thereto are undertakings from one Member State and the agreements, decisions or practices do not relate either to imports or exports between Member States, or where not more than two undertakings are party thereto and the agreements only restrict the freedom of one party to the contract in determining the prices or conditions of business on which the goods he has obtained from the other party to the contract may be resold; whereas this dispensation does not cover mot agreements caught by Articles 81(1) of the Treaty which are entered into by two or more undertakings, each operating, for the purposes of the agreement, at a different level of the production or distribution chain, and which relate to the conditions under which the parties may purchase, sell or resell certain goods or services ("vertical agreements");

The Commission may (retrospectively) revoke or amend its decision or prohibit specified acts by the parties where there has been a change in any of the facts which were basic to the making of the decision, if the parties commit a breach of any obligation attached to the decision, if the decision is based on incorrect information or was induced by deceit or if the parties abuse the exemption from Article 81(1) granted to them by the decision.
