The judgement in case C-430/11 (Sagor) (related to compatibility of provisions of Italian national legislation imposing the penal sanctions of assignment to stay at home and immediate expulsion for illegal stay) was delivered in December 2012 and further refined the ECJs case law on this issue.
L’arrêt rendu en décembre 2012 dans l’affaire C-430/11 (Sagor) (relative à la compatibilité des dispositions de la législation italienne soumettant les séjours irréguliers aux sanctions pénales de l'assignation à résidence et de l’expulsion immédiate) a encore affiné la jurisprudence de la CJUE en la matière.

8. Regards the amendment to Article 301 of the Penal Code, presented by the government to the parliament, as merely a first step towards a fundamental reform of that article as well as other articles of the Penal Code, and urges the government and the parliament to carry out this reform without delay so that none of the articles in question can any longer be used for the purpose of placing arbitrary restrictions on freedom of expression; deplores the fact that no progress has been achieved regarding freedom of expression, and that the number of persons prosecuted under legal provisions allowing for arbitrary restrictions on the expression of non-violent opinion has further increased in 2007; underlines that, once the urgently needed modification of Article 301 has been completed, further legislative and implementation steps will be required in order to ensure that Turkey fully guarantees freedom of expression and press freedom in line with the standards enshrined in the European Convention on Human Rights (ECHR);

Considers the changes to Article 301 of the Penal Code, adopted by the Turkish parliament on 30 April 2008, to be a first step towards a fundamental reform of that article as well as other articles of the Penal Code, and looks forward to further moves in this respect; stresses that progress has to be achieved regarding freedom of expression, both in theory and in practice; deplores the fact that the number of persons prosecuted under legal provisions allowing for arbitrary restrictions on the expression of non-violent opinion has further increased in 2007 ; is of the view that the repeal of Article 301 and other legal provisions representing an illegitimate restriction on freedom of expression as guaranteed by international law would be the best solution in order to ensure that Turkey fully guarantees freedom of expression and press freedom in line with the standards enshrined in the European Convention for the protection of Human Rights and Fundamental Freedoms (ECHR);
9. considère que les modifications de l'article 301 du code pénal, , adoptées par le parlement turc le 30 avril 2008, constituent, un premier pas dans la voie d'une réforme fondamentale de cet article ainsi que d'autres articles du code pénal, et attend de nouvelles initiatives à cet égard; souligne que des progrès doivent être réalisés quant à la liberté d'expression, tant sur le plan théorique que dans la pratique; déplore le fait que le nombre de personnes poursuivies sur la base de dispositions juridiques autorisant des restrictions arbitraires à l'expression d'opinions non violentes a encore augmenté en 2007 ; considère que l'abrogation de l'article 301 du code pénal et d'autres dispositions juridiques représentant une restriction injustifiable de la liberté d'expression garantie par le droit international serait la meilleure solution pour assurer que la Turquie garantisse pleinement la liberté d'expression et la liberté de la presse, conformément aux normes consacrées par la Convention européenne de sauvegarde des droits de l'homme et des libertés fondamentales (CEDH);

If, despite the measures taken by the competent authority of the home Member State or because such measures prove inadequate, the reinsurance undertaking persists in infringing the legal provisions applicable to it in the host Member State, the latter may, after informing the competent authority of the home Member State, take appropriate measures to prevent or penalize further infringements, including in so far as is strictly necessary, preventing that reinsurance undertaking from continuing to conclude new reinsurance contracts within its territory.
