As noted by the International Bureau of WIPO, perhaps one of the most significant contributions of the WCT and the WPPT is their recognition of the rights of authors, performers and phonogram producers to authorize the online transmission of their works, fixed performances and phonograms, as the case may be.21 The WCT and WPPT provide that authors, performers and producers of phonograms must be granted exclusive rights to authorize the making available of their works, performances fixed on phonograms and phonograms, respectively, by wire or wireless means, in such a way that members of the public may access those works, performances and phonograms from a place and at a time individually chosen by the members of the public (that is, interactive, on-demand services).

While those companies could that they have to wait longer to produce phonograms in which the performers and phonogram producers' rights have expired, the works performed in a phonogram would not lose protection once the term of protection for the phonogram expires.

The Diplomatic Conference held in December 1996, under the auspices of the World Intellectual Property Organization (WIPO), led to the adoption of the WIPO Performances and Phonograms Treaty, which deals with the protection of performers and producers of phonograms.

As far as performances and phonograms are concerned, these right holders will be able to benefit from an exclusive right of reproduction, distribution, rental, and making it available to the public (over networks) of their performances and phonograms. Moreover performers and phonogram producers will also benefit from a right of remuneration for broadcasting and all other forms of communication to the public of phonograms published for commercial purposes.
