3. Where it is established that the ratio referred to in paragraph 2 has decreased by more than 5 % at regional or sub-regional level or, where applicable, at national level, the Member State concerned shall impose obligations at holding level to reconvert land into permanent grassland for those farmers who have land at their disposal which was converted from land under permanent pasture or from permanent grassland into land for other uses during a period in the past.

"areas of permanent grassland" means the land under permanent pasture declared in 2012, or 2013 in the case of Croatia, in accordance with Regulation (EC) No 73/2009 by the farmers subject to the obligations under this Chapter, as well as the areas of permanent grassland declared in 2015 in accordance with point (a) of the first subparagraph of Article 72(1) of Regulation (EU) No 1306/2013 by the farmers subject to the obligations under this Chapter that have not been declared as land under permanent pasture in 2012 or, in the case of Croatia, 2013.

In order to take account of paragraph 3, the Commission shall be empowered to adopt delegated acts in accordance with Article 115 laying down the rules on maintenance of permanent pasture, in particular in order to ensure that measures are taken to maintain the land under permanent pasture at the level of farmers, including individual obligations to be respected such as obligation to reconvert areas into permanent pasture where it is established that the ratio of land under permanent pasture is decreasing.
4. Afin de prendre en considération les éléments visés au paragraphe 3, la Commission est habilitée à adopter, en conformité avec l'article 115, des actes délégués contenant les règles relatives au maintien des pâturages permanents, destinés en particulier à assurer l'adoption de mesures visant à maintenir les terres en pâturages permanents au niveau des agriculteurs, comprenant notamment les obligations individuelles de reconversion des surfaces en pâturages permanents lorsqu'il est établi que la proportion de ces pâturages est en diminution.

Where the arable land covers more than 10 hectares, farmers shall ensure, during the first year of implementation of the present regulation, that at least 3% of their eligible hectares as defined in Article 25(2), excluding areas under permanent grassland and permanent pasture and permanent crops, is ecological focus area such as land left fallow, terraces, landscape features including hedgerows, ditches, stonewalls, in field trees and ponds, land planted with nitrogen-fixing crops, buffer strips and afforested areas as referred to in article 25(2)(b)(ii).

2. Where it is established that the obligation referred to in Article 3(2) of this Regulation cannot be ensured, the Member State concerned shall, further to the measures to be taken in accordance with paragraph 1, provide, at national or regional level, for the obligation of farmers applying for aid under any of the direct payment schemes listed in Annex I of Regulation (EC) No 1782/2003 to re-convert land into land under permanent pasture for those farmers who have land at their disposal which was converted from land under permanent pasture into land for other uses.
2.
