The two measures are compatible with the EU internal market because they do not overcompensate the postal operator and so comply with Article 106(2) of the Treaty on the Functioning of the European Union (TFEU), which governs the application of competition rules to services of general economic interest.

It is appropriate to provide Member States that have acceded to the Union after the entry into force of Directive 2002/39/EC of the European Parliament and of the Council of 10 June 2002 amending Directive 97/67/EC with regard to the further opening to competition of Community postal services and may have faced particular difficulties regarding the smooth adaptation of their postal markets because they joined the postal reform process at a late stage, and certain Member States with a small population and a limited geographical size having specific characteristics that are particular to postal services or with a particularly difficult topography, with a huge number of islands with the possibility to postpone the implementation of this Directive for a limited period of time, in order to continue to reserve services to their universal service provider(s), subject to notification to the Commission.

Other market players, such as national postal operators, can only compete to a limited extent because they do not reach comparable efficiency or reliability, given their heavy reliance on road rather than air transport.

Could we not adopt a new approach, a new form of marketing for postal services and not a defensive attitude like the one which led to the closing of many post offices, not because the clientele was decreasing, but because the post master was retiring?
